By virtue of a power of sale contained in those certain Deeds to Secure Debt from LEDO PROPERTIES COMPANY, A Georgia General partnership, to CENTRAL BANK OF GEORGIA, subsequently assigned to AMERIS BANK by FEDERAL DEPOSIT INSURANCE CORPORATION as Receiver of CENTRAL BANK OF GEORGIA, dated August 31, 2007, recorded in Deed Book 1201 at Page 292 and dated November 13, 2008, recorded in Deed Book 1297 at Page 309, of the Superior Court of Lee County, Georgia; said Deeds to Secure Debt having been sold, assigned, transferred and conveyed to Ameris Bank, by Assignment, securing a Note in the original principal amount of TWO HUNDRED FIFTY-TWO THOUSAND FIVE HUNDRED EIGHTY-FOUR NO/100 DOLLARS ($252,584.00), of even date therewith, as well as all extensions, renewals and modifications thereof, together with any and all other indebtedness, of any type or descriptions, then or thereafter owing by LEDO PROPERTIES COMPANY to AMERIS BANK, as assignee of CENTRAL BANK OF GEORGIA by and through FEDERAL DEPOSIT INSURANCE CORPORATION as Receiver of CENTRAL BANK OF GEORGIA, there will be sold by the undersigned, at public outcry, to the highest bidder for cash, before the courthouse door at Leesburg, Lee County, Georgia, within the legal hours of sale on the first Tuesday in August, 2012, the following described property:
All that tract or parcel of land lying and being Land Lots 265 and 266 of the 2nd Land District of Lee County, Georgia and being more particularly described as Lots 17, 18, 19, 20, 23, 24, 25 and 27 of Grand Island Subdivision, section One, per a map or plat of said subdivision as recorded in Plat Cabinet D, Slide D-151 in the Office of the Clerk of Superior Court of Lee County, Georgia, which plat together with all of its courses and distances is incorporated into and made a part of this description by specific reference thereto.
The indebtedness secured by the aforementioned Deeds to Secure Debt has been and is hereby declared immediately due and payable in full because of the failure of LEDO PROPERTIES COMPANY, to maintain payments upon said indebtedness owing to AMERIS BANK, as assignee of CENTRAL BANK OF GEORGIA, in accordance with its terms. Said indebtedness remaining in default, this sale shall be made for the purpose of paying such indebtedness, as well as all expenses of this sale, including attorney fees.
The above described property will be sold as the property of LEDO PROPERTIES COMPANY and will be sold subject to the following items which may affect the title to said property: all zoning and subdivision ordinances and/or regulations; matters which would be disclosed by an accurate survey or an inspection of the property; all real property ad valorem taxes or assessments, which may constitute liens upon said property; all liens which, under applicable law, would take priority over the Deeds to Secure Debt described above; and all easements, restrictions, rights-of-way, security deeds or other encumbrances of record which have priority over the referenced Deeds to Secure Debt.
To the best of the knowledge and belief of the undersigned, the party presently in possession of said property is LEDO PROPERTIES COMPANY, and/or a tenant or tenants.
