NOTICE TO THE PUBLIC YOU ARE HEREBY NOTIFIED that on the 15th day of August, 2012, at 8:30AM, at the Courthouse in Columbus, Georgia, Judge Frank J. Jordan, Jr. , of the Superior Court of Muscogee County will hear the case of the STATE OF GEORGIA, Plaintiff, v. DEVELOPMENT AUTHORITY OF COLUMBUS, GEORGIA and GREYSTONE FARMS APARTMENT COMMUNITY, LLC, Defendants, Civil Action File No. SU-12-CV-2741, in the Superior Court of Muscogee County, the same being a proceeding to confirm and validate an issue of Development Authority of Columbus, Georgia Taxable Revenue Bonds (Woodmont Properties, LLC Ð Greystone Farms Project), Series 2012, in the aggregate principal amount not to exceed $21,130,000.00 (the ÒBondsÓ). The Bonds are to be issued by Development Authority of Columbus, Georgia (the ÒIssuerÓ) for the purpose of refinancing the Development Authority of Columbus, Georgia Taxable Revenue Bonds (Woodmont Properties, LLC Ð Greystone Farms Project), Series 2012 in the principal amount of $20,764,400.00 which were issued to refinance the Development Authority of Columbus, Georgia Taxable Revenue Bonds (Woodmont Properties, LLC Ð Greystone Farms Project), Series 2000, in the aggregate principal amount of $11,000,000.00 and the Development Authority of Columbus, Georgia Taxable Revenue Bond Woodmont Properties, LLC Ð Greystone Farms II Project), Series 2006, in the aggregate principal amount of $10,130,000.00 which were issued for the purpose of paying the construction indebtedness of the Greystone Farms Apartments Complex, 7401 Blackmon Road, Columbus, Georgia 31909. The Bonds shall not be deemed to constitute a debt of Columbus, Georgia, the State of Georgia or any other political subdivision thereof, or a pledge of the faith and credit of Columbus, Georgia, the State of Georgia or any other political subdivision thereof, but such Bonds shall be payable solely as provided for in the Lease Agreement between Development Authority Of Columbus, Georgia and Greystone Farms Apartment Community, LLC, and the issuance of the Bonds shall not directly, indirectly, or contingently obligate Columbus, Georgia, the State of Georgia or any other political subdivision thereof, to levy or to pledge any form of taxation whatever or to make any appropriation for the payment therefor. THE AUTHORITY HAS WAIVED THE PERFORMANCE AUDIT AND PERFORMANCE REVIEW REQUIREMENTS PROVIDED IN O.C.G.A. Section 36-82-100 AND WILL CONDUCT NO PERFORMANCE AUDIT OR PERFORMANCE REVIEW WITH RESPECT TO THE BONDS. Any citizen of the State of Georgia residing in Columbus, Georgia, or any other person wherever residing who has a right to object, may intervene and become a party to this proceeding.
