Notice of Sale Under Power

Georgia, Barrow County

Under and by virtue of the power of sale contained in a Security Deed from ANTONY THALIATH A/K/A ANTHONY THALIATH to MAIN STREET BANK N/K/A BRANCH BANKING AND TRUST COMPANY, dated December 23, 2005, recorded December 29, 2005, in Deed Book 1138, Page 395, Barrow County, Georgia records, as modified by that certain Modification Agreement dated June 30, 2011, recorded in Deed Book 1580, Page 238, Barrow County, Georgia records, said Security Deed being given to secure a Note from TALIAT INVESTMENTS, INC., with interest from date at a rate per cent per annum on the unpaid balance until paid; there will be sold by the undersigned at public outcry to the highest bidder for cash before the Courthouse door at Barrow County, Georgia, within the legal hours of sale on the first Tuesday in December, 2012, the following described property:

All that tract or parcel of land lying and being in GMD No. 1744 of Barrow County, Georgia and being more particularly described as Tract No. 1 in plat of survey prepared by Borders & Associates, dated July 10, 1984, titled Survey for W.P. Kenyon, et al , and recorded in Plat Book 22, Page 158 of the Barrow County Plat Records. Said plat and the description therein are incorporated herein by reference. Said tract consists of 16.051 acres, more or less.

The debt secured by said Security Deed has been and is hereby declared due because of, among other possible events of default, failure to pay the indebtedness as and when due and in the manner provided in the Note and Security Deed. The debt remaining in default, this sale will be made for the purpose of paying the same and all expenses of this sale, as provided in the Security Deed and by law, including attorney s fees (notice of intent to collect attorney s fees having been given).

Said property will be sold subject to any outstanding ad valorem taxes (including taxes which are a lien, but not yet due and payable), any matters which might be disclosed by an accurate survey and inspection of the property, any assessments, liens, easements, encumbrances, zoning ordinances, restrictions, covenants, and matters of record superior to the Security Deed first set out above.

To the best knowledge and belief of the undersigned, the party in possession of the property is ANTONY THALIATH A/K/A ANTHONY THALIATH or a tenant or tenants.
