By virtue of the power of sale contained in the Security Deed by and between KENNETH D. LUMPKIN AND CAROL S. LUMPKIN, ( Borrower ) to FREEDOM BANK OF GEORGIA ( Lender ) dated February 8, 2008, and recorded in Deed Book 1380, Page 271, Barrow County Records, held by NORTHEAST GEORGIA BANK, pursuant to that Purchase and Assumption Agreement among Federal Deposit Insurance Corporation, Receiver of Freedom Bank of Georgia, Commerce, GA, Federal Deposit Insurance Corporation and Northeast Georgia Bank, dated March 6, 2009, conveying the realty described on Exhibit A attached hereto as collateral for the debt in the principal amount of $66,000.00 together with all late fees and interest from dates of execution at the rates provided therein on the unpaid balance; there will be sold by the undersigned at public outcry to the highest bidder for cash before the courthouse door at Barrow County Georgia, within the legal hours of sale on the first Tuesday of December, 2012 the realty in the 243rd District, Barrow County, Georgia, being more completely described as follows:


ALL THAT TRACT OR PARCEL OF LAND, together with all improvements thereon, situate, lying and being in the City of Winder, 243rd District, G.M., Barrow County, Georgia, designated as Tract 2, containing 0.193 of an acre, more or less, as shown by plat and survey entitled Survey for Claude Tuck, Jr. Realty Company , prepared by Borders and Associates, certified by Paul E. Borders, GRLS No. 1995, dated October 29, 1998, recorded in Plat Book 50, page 154, Barrow County, Georgia records; which plat and the recording thereof are hereby incorporated herein by reference for a more detailed description of the property.

Said property bears the address 104 KING STREET, WINDER, GEORGIA 30680.

The debt secured by said Security Deed has been and is hereby declared due and payable because, among other possible events of default, of the Borrower s failure to pay the interest and principal when due. The debt remaining in default, this sale will be made for the purpose of paying the same and all expenses of this sale, including attorney s fees.

Said property will be sold subject to any outstanding ad valorem taxes (including taxes which are a lien, but not yet due and payable), and any matters which might be disclosed by an accurate survey and inspection of the property, any assessments, liens, encumbrances, zoning ordinances, restrictions, covenants, and matters of record superior to the Security Deed first set out above.

To the best knowledge and belief of Grantee, the party in possession of the property is Borrower or a tenant or tenants.
