By virtue of the power of sale contained in a Security Deed from BRENT COOK and CHRISTINA COOK to MORTGAGE ELECTRONIC REGISTRATION SYSTEMS INC., as nominee for ACCESS NATIONAL MORTGAGE dated February 15, 2008 recorded in Deed Book 1386, Page 0834 , Barrow County Records, and last assigned to JPMorgan Chase Bank, National Association s/b/m Chase Home Finance LLC, conveying the after-described property to secure a Note in the original principal amount of ONE HUNDRED FORTY-FOUR THOUSAND FOUR HUNDRED ONE AND 00/100 ($144,401.00), with interest thereon as set forth therein, there will be sold at public outcry to the highest bidder for cash, before the Courthouse door of Barrow County, Georgia, during the legal hours of sale on the first Tuesday, February 5, 2013 the following described property, to wit:

All that tract or parcel of land lying and being in the 1742nd General Militia District of Barrow County, Georgia, and being more particularly described as Lot 17, Block A, Kirkland Manor subdivision according to a plat of survey dated September 26, 2005, by Ring Abernathy & Associates, certified by S. Guy Abernathy, Georgia Registered Land Surveyor No. 16202, as recorded in Plat Book 58, Page 115, Barrow County, Georgia Records, which plat is incorporated herein and made a part hereof by reference thereto for a more complete description of the property conveyed herein.

For informational purposes only: the APN is shown by the County Assessor as XX126C-017; source of title is Book 1234, Page 0842 (Recorded 10/04/06).

The Debt secured by said Security Deed has been and is hereby declared due because of nonpayment of the indebtedness when due and in the manner provided in the Note and Security Deed. The debt remaining in default, the sale will be made for the purpose of paying the same and all expenses of sale, as provided in the Security Deed and by law, including attorney s fees, notice of intent to collect attorney s fees having been given.

Said property will be sold subject to any outstanding ad valorem taxes, any assessments, liens, encumbrances, zoning ordinances, restrictions, covenants, and matters of record superior to the Security Deed first set out above.

To the best knowledge and belief of the undersigned, the party in possession of the property Brent Cook and Christina Cook or, a tenant or tenants, and said property was or is commonly known as 2005 Kirkland Circle, Statham, GA 30666.

The sale will be conducted subject (1) to confirmation that the sale is not prohibited under the U.S. Bankruptcy Code and (2) to final confirmation and audit of the status of the loan with the holder of the security deed.
