( MERS ) AS NOMINEE FOR GMFS,LLC, LIMITED LIABILITY CORPORATION , dated 08/11/2011, and Recorded on 08/30/2011 as Book No. 805 and Page No. 473, JONES County, Georgia records, as last assigned to WELLS FARGO BANK, NATIONAL ASSOCIATION (the Secured Creditor), by assignment, conveying the after-described property to secure a Note of even date in the original principal amount of $65,612.00, with interest at the rate specified therein, there will be sold by the undersigned at public outcry to the highest bidder for cash at the JONES County Courthouse within the legal hours of sale on the first Tuesday in December, 2012, the following described property: ALL THAT TRACT OR PARCEL OF LAND SITUATE, LYING AND BEING IN LAND LOT NO. 131 OF THE 8TH LAND DISTRICT OF JONES COUNTY, GEORGIA, AND BEING KNOWN AND DISTINGUISHED AS PARCEL A CONTAINING 1.85 ACRES IN A SUBDIVISION OF THE M.B. SOUTHER PROPERTY - TRACT NO. 2 MORE PARTICULARLY DESCRIBED ACCORDING TO PLAT OF RECORD IN DEED BOOK 3-V, PAGE 236, CLERKS OFFICE, JONES SUPERIOR COURT, WHICH SAID PLAT IS BY THIS REFERENCE THERETO INCORPORATED HEREIN FOR THAT PURPOSE OF A MORE PARTICULARLY AND ACCURATE DESCRIPTION OF SAID PARCEL A HEREBY CONVEYED.
THERE ARE IMPROVEMENTS LOCATED THEREON KNOWN UNDER THE PRESENT SYSTEM OF NUMBERING AS 3720 JOYCLIFF ROAD, MACON, JONES COUNTY, GEORGIA. THE PROPERTY HEREINABOVE DESCRIBED AND CONVEYED IS THE SAME AND IDENTICAL PROPERTY CONVEYED TO LARRY N. HUEKEBA AND MARY J. HUCKEBA BY THE FOLLOWING CONVEYANCE:
(1) WARRANTY DEED FROM JERRELL M. BUMS AND ALICE D. BUMS DATED JUNE 15, 1979 AND RECORDED IN DEED BOOK 163, PAGE 210 CLERKS OFFICE, JONES SUPERIOR COURT.
(2) QUIT-CLAIM DEED FROM LARRY N. HUCKEBA DATED SEPTEMBER 2, 1992 AND RECORDED IN DEED BOOK 272, PAGE 330, CLERKS OFFICE, JONES SUPERIOR COURT.
ALSO, ALL AT TRACT OR PARCEL OF LAND SITUATE, LYING AND BEING IN LAND LOT NO. 131 OF THE 8TH LAND DISTRICT OF JONES COUNTY, GEORGIA, CONTAINING 0.30 ACRES, MORE PARTICULARLY DESCRIBED IN PLAT OF RECORD IN PLAT BOOK 14, PAGE 68, CLERKS OFFICE, JONES SUPERIOR COURT, WHICH SAID PLATS BY MORE PARTICULAR AND ACCURATE DESCRIPTION OF SAID 0.30 ACRES HEREBY CONVEYED.
THE PROPERTY HEREINABOVE LAST DESCRIBED 0.30 ACRES IS THE SAME IDENTICAL PROPERTY CONVEYED TO LARRY N. HUCKEBA AND MARY J. HUCKEBA BY OLD SOUTH LAND AND TIMBER ENTERPRISES, INC, ET ALL BY WARRANTY DEED DATED NOVEMBER 18, 1996, RECORDED IN DEED BOOK 329, PAGE 100, CLERKS OFFICE, JONES SUPERIOR COURT. The debt secured by said Deed to Secure Debt has been and is hereby declared due because of, among other possible events of default, failure to pay the indebtedness as and when due and in the manner provided in the Note and Deed to Secure Debt. Because the debt remains in default, this sale will be made for the purpose of paying the same and all expenses of this sale, as provided in the Deed to Secure Debt and by law, including attorney s fees (notice of intent to collect attorney s fees having been given). WELLS FARGO BANK, NATIONAL ASSOCIATION holds the duly endorsed Note and is the current assignee of the Security Deed to the property. Said property will be sold subject to (a) any outstanding ad valorem taxes (including taxes which are a lien, but not yet due and payable), (b) any matters which might be disclosed by an accurate survey and inspection of the property, and (c) all matters of record superior to the Deed to Secure Debt first set out above, including, but not limited to, assessments, liens, encumbrances, zoning ordinances, easements, restrictions, covenants, etc. The sale will be conducted subject to (1) confirmation that the sale is not prohibited under the U.S. Bankruptcy Code; and (2) final confirmation and audit of the status of the loan with the holder of the security deed.
