PROPOSED CONSENT ORDER

NATIONAL POLLUTANT DISCHARGE ELIMINATION SYSTEM PERMIT NO. GA0003280

The Georgia Environmental Protection Division (EPD) will be holding a public hearing at 7:00 p.m. on Tuesday March 5, 2013. The hearing will be held at the Effingham County High School located at 1589 Highway 119 South, Springfield, Georgia 31329.



The purpose of the public hearing will be to receive comments on the proposed King America Finishing, Inc. Consent Order to address alleged violations of the Georgia Water Quality Control Act. The proposed Consent Order includes conditions requiring King America Finishing, Inc., to implement supplemental environmental projects (SEPs) to benefit the Ogeechee River Watershed.



THE PUBLIC HEARING WILL BE CONFINED TO WATER QUALITY ISSUES AS THEY RELATE TO THE CONSENT ORDER. THIS HEARING WILL NOT CONSIDER LAND USE, ZONING, OR OTHER ISSUES.

The public hearing is a formal process to receive comments on the proposed Consent Order. EPD will make a brief presentation at the beginning of the hearing. Participants who wish to comment for the record are requested to sign in upon arrival. Hearing participants will not be subject to questions from the audience, but may be questioned by the Hearing Officer for clarification of technical points or to develop a better understanding of statements. Questions asked by participants making statements will be answered by EPD in writing at a later date. Lengthy statements or statements of a considerable technical or economic nature should be submitted in writing for the official record. During the hearing, oral statements shall be limited to three minutes to allow everyone an opportunity to be heard. Written comments are welcomed.

To ensure their consideration, written comments should be received by close of business on March 15, 2013. The proposed Consent Agreement, comments received, and other information are available for review at EPD's Coastal District Office located at 400 Commerce Center Drive, Brunswick, Georgia 31523 and at 4220 International Parkway, Suite 101, Atlanta, Georgia 30354 between the hours of 8:00 a.m. and 4:30 p.m., Monday through Friday.
