NOTICE OF SALE UNDER POWER OF SECURITY DEED
By virtue of a Power of Sale contained in a security deed from RACO CONSTRUCTION & DEVELOPMENT, LLC to MOUNTAIN HERITAGE BANK dated April 4, 2011 and recorded in Deed Book 750, pages 760-766 of the Habersham County deed records given to secure a promissory note dated April 14, 2006 in the principal amount of ONE HUNDRED THIRTY FIVE THOUSAND AND 00/100 ($135,000.00) DOLLARS, there will be sold at public outcry to the highest and best bidder for cash before the Courthouse door of Habersham County, Georgia, within the legal hours of sale on the first Tuesday in September, to-wit: September 4, 2012, the following described property:
ALL THAT TRACT OR PARCEL of land lying and being in Land Lots 95 of the 13th Land District of Habersham County, Georgia, being shown and designated as Lot 13, containing 1.059 acres, more or less and Lot 14, containing 1.042 acres more or less, Phase 14 of The Orchard Subdivision, on a plat of survey prepared by Eddie Davidson, under date of June 28, 2004, a copy of said plat being of record in the office of the Clerk of Superior Court of Habersham County, Georgia, in Plat Book 56 Page 136, to which said plat and the record thereof reference is hereby made for a more complete description.
TOGETHER WITH a permanent non exclusive easement for ingress and egress, to and from the above-described property, via the courses of the existing subdivision roads as shown on the plat referred to above.
The debt secured by said Security Deed has been and is hereby declared due because of, among other possible events of default, non-payment of said debt. The debt remaining in default, this sale will be made for the purpose of paying the same and all expenses of this sale, including attorneys fees.
The said property will be sold as the property of RACO CONSTRUCTION & DEVELOPMENT, LLC subject to any outstanding ad valorem taxes and assessments and to the best knowledge and belief of the undersigned RACO CONSTRUCTION & DEVELOPMENT, LLC is in possession of said property. A copy of this notice was mailed to the debtor by and thru its registered agent to-wit: Carl Blackburn. A copy of this notice was mailed to the debtor by and thru its manager to-wit: Carl Blackburn by certified mail, return receipt requested on August 3, 2012 in compliance with O.C.G.A. 44-14-162.2.
