RN6032 STATE OF GEORGIA COUNTY OF FLOYD NOTICE OF SALE UNDER POWER IN DEED TO SECURE DEBT Under and by virtue of the power of sale contained in that certain Deed to Secure Debt from Helen Hayes Williams to Mortgage Electronic Registration Systems, Inc. in the original principal amount of $77,000.00 dated 02/21/2006, and recorded in Deed Book 1995, page 760, Floyd County records, said Security Deed being last transferred and assigned to CitiMortgage, Inc. in Deed Book 2265, Page 2265, the undersigned will sell at public outcry to the highest bidder for cash before the Courthouse door in said County, during the legal hours of sale, on the first Tuesday of August, 2012 by CitiMortgage, Inc., as Attorney-in-Fact for Helen Hayes Williams the following described property: All that tract or parcel of land situated, lying and being in Land Lot 87 in the 4th District and 4th Section of Floyd County, Georgia, and in the City of Rome, Georgia, and being Lot 103 of Garden Lakes Subdivision, Part 23-C, according to a plat of said subdivision recorded in Plat Book 19, Page 39, in the Office of the Clerk of the Superior Court of Floyd County, Georgia, and being more particularly described as BEGINNING at a point on the southerly right of way line of Sagewood Drive, said point being 120.00 feet westerly, as measured along the southerly line of Sagewood Drive, from the point of intersection of said southerly line of Sagewood Drive with the westerly right of way line of Green Leaf Trail, and from said beginning point running thence South 00 degrees 13 minutes East 150.00 feet; thence South 89 degrees 47 minutes West 115.00 feet; thence North 00 degrees 13 minutes West 150.00 feet to a point on the southerly line of Sagewood Drive; thence North 89 degrees 47 minutes East and along the southerly line of Sagewood Drive 115.00 feet to the beginning point. Said description is in accordance with a survey and plat for Helen Hayes Williams prepared by Grover H. Higgins, Registered Land Surveyor, dated December 15, 1992. The improvements thereon being known as No. 103 Sagewood Drive NW, Rome, GA 30165 Being the same property which by Indenture dated December 17, 1992 and recorded December 18, 1992 among the land records of Floyd County, State of Georgia in Book 1130, Page 316, was granted and conveyed by Lakes Construction Company, Inc unto Helen Hayes Williams. PARCEL ID No.; H12Y-08Y Property known as: 103 Sagewood Drive Northwest, Rome, GA 30165 The indebtedness secured by said Deed to Secure Debt having been declared due and payable because of default in the payment of the indebtedness secured thereby, this sale will be made for the purposes of paying the same and all expenses of sale, including attorney's fees, (notice having been given as provided by law). The property will be sold as the property of The Aforesaid Grantors subject to the following: (1) all prior restrictive covenants, easements, rights-of-way or encumbrances; (2) all valid zoning ordinances; (3) matters which would be disclosed by an accurate survey of the property; (4) the outstanding ad valorem taxes and assessments, if any; (5) unpaid water and sewage bills, that constitute liens against the property, whether due and payable or not yet due and payable; and (6) matters of record superior to the security deed first set out above.
