RN6047 NOTICE OF SALE UNDER POWER STATE OF GEORGIA, COUNTY OF FLOYD. By virtue of the power of sale contained in a Commercial Deed to Secure Debt and Security Agreement by Jennifer G. Holcombe, as Grantor to Georgia Bank and Trust dated July 29, 2009, and recorded in Deed Book 2198, Page 934, Floyd County, Georgia, Deed Records, and conveying the after-described property to secure a Note from Joel C. Holcombe to GB&T A Division of Synovus Bank in the original principal amount of EIGHTY-SEVEN THOUSAND TWO HUNDRED EIGHTY-SEVEN AND 50 /100 ($87,287.50), there will be sold at public outcry for cash to the highest bidder before the courthouse doors in said county during the legal hours of sale, on the first Tuesday in August, 2012, by Georgia Bank & Trust a Division of Synovus Bank, as attorney-in-fact for Jennifer G. Holcombe the following described property, to-wit: ALL THAT TRACT OR PARCEL OF LAND lying and being in Land Lots 265, 266 and 275 of the 4th District and 4th Section of Floyd County, Georgia; and being Lots 2, 3, 4, 5, 11 and 18 of Horseleg Ridge Subdivision, Phase One, according to a plat of survey as recorded at Plat Book 18, Page 216, Floyd County, Georgia records, which plat by reference is incorporated herein and made a part hereof. LESS AND EXCEPT: That certain portion of Lot 18 previously conveyed to Doug & Eleanor Holstein on April 29, 2004 which deed is recorded in Deed Book 1868, Page 946, aforesaid records. The indebtedness secured by said Commercial Deed to Secure Debt and Security Agreement having been declared due and payable because of default in the payment of the indebtedness secured thereby, the sale will be made for the purpose of paying the same and all expenses of the sale, including attorneys' fees (notice of intent to collect attorneys' fees having been duly given). The property will be sold as the property of the aforesaid grantor subject to the following: (1) all prior restrictive covenants, easements, rights-of-way, and encumbrances, including, but not limited to, those recorded in the deed records maintained by the Clerk of Floyd County Superior Court; (2) all zoning ordinances; (3) matters which would be disclosed by an accurate survey of the property; and (4) outstanding ad valorem taxes and assessments, if any, and unpaid water and sewage bills, that constitute liens against the property, whether due and payable or not yet due and payable.
