NOTICE OF SALE UNDER POWER
CONTAINED IN SECURITY DEED
STATE OF GEORGIA,
Pursuant to a power of sale contained in a certain Security Deed executed by GEORGE ROBINSON (hereinafter referred to as "Grantor") to KAREN WHELAN and dated AUGUST 11, 2011 and recorded in Deed Book 2272, Page 1254, in the Office of the Clerk of the Superior Court of Floyd County, Georgia, and securing a Note in the original principal amount of $16,000.00 and by virtue of a default in the payment of the debt secured by said Security Deed the undersigned KAREN WHELAN as attorney in fact for the aforesaid Grantor has declared the entire indebtedness due and payable and pursuant to the power of sale contained in said deed will sell at public outcry to the highest bidder for cash before the courthouse door at Floyd County, Georgia within the legal hours of sale on the first Wednesday in January, 2013, the following described property:
All that tract or parcel of land situated, lying and being Lot 33 of Garden Homes Subdivision, Part 3 (Plat book 2, Page 182), located in Land Lot 201 of the 23rd District and 3rd Section of Floyd County, Georgia, and in the Third Ward of the City of Rome, Georgia, and being more particularly described as follows:
Beginning at a 2 inch rod placed on the west line of Springdale Drive, said point being 380.0 feet south of the intersection line of Brookwood Avenue with the western line of Springdale Drive and from said POINT OF BEGINNING running thence along said western line of Springdale Drive in a southern direction in an arc a distance of 78.6 feet to a 2 inch pipe found, which said point is south 17 degrees 37 minutes 35 seconds west a chord distance of 78.44 feet from said previous point; thence north 66 degrees 37 minutes 00 seconds west 136.63 feet to a fence corner; thence north 01 degrees13 minutes 18 seconds east 50.0 feet to a 2 inch rod placed; thence south 78 degrees 45 minutes 03 seconds east 151.00 feet to the point of beginning on the westerly line of Springdale Drive. Said legal description is in accordance with a survey prepared by Horne Associates, dated September 13, 1995.
SAID SALE WILL BE MADE SUBJECT TO THE FOLLOWING ITEMS WHICH MAY EFFECT THE TITLE TO SAID PROPERTY: All restrictive covenants; easements and rights of way, if any; all zoning ordinances; matters which would be disclosed by an accurate survey or by an inspection of the property; all outstanding and/or unpaid taxes which may be liens upon the property.
To the best knowledge and belief of the undersigned, the subject property has a street address of 9 SPRINGDALE DRIVE, ROME, GEORGIA, 30165, and the party in possession of the subject property is GEORGE ROBINSON.
The proceeds of said sale will be applied to the payment of said indebtedness, the expense of said sale, all as provided in said deed and by law, including attorney s fees (notice of intent to collect attorney s fees having been duly given). The undersigned will execute a deed to the purchaser as provided in the aforementioned Security Deed.
