NOTICE OF SALE UNDER POWER

FLOYD COUNTY

THIS LAW FIRM IS ACTING AS A DEBT COLLECTOR ATTEMPTING TO COLLECT A DEBT. ANY INFORMATION OBTAINED WILL BE USED FOR THAT PURPOSE.

Under and by virtue of the power of sale contained in that certain Deed to Secure Debt from Jason Eric Morris to Family Savings Federal Credit Union (N/K/A Family Savings Credit Union), dated November 16, 2006 and recorded in Deed Book 2048, Page 814, Floyd County, Georgia Records, said Deed to Secure Debt having been given to secure a Note dated November 16, 2006 by Jason Eric Morris and Patricia Jo Morris, in the original principal amount of $28,000.00, there will be sold by the undersigned at public outcry to the highest bidder for cash before the Courthouse door at Floyd County, Georgia, within the legal hours of sale on Tuesday, January 8, 2013, the property described on "Exhibit A" attached hereto and incorporated herein by reference. The debt secured by said Deed to Secure Debt has been and is hereby declared due because of, among other possible events of default, failure to make timely payments of principal and interest. The debt remaining in default, this sale will be made for the purpose of paying the same and all expenses of this sale, including attorney's fees (notice of intent to collect attorney s fees having been given).

Said property will be sold subject to any outstanding ad valorem taxes (including taxes which are a lien, but not yet due and payable), any matters which might be disclosed by an accurate survey and inspection of the property, and any assessments, liens, encumbrances, zoning ordinances, restrictions, covenants, and matters of record superior to the Security Deed first set out above.

To the best of the undersigned's knowledge and belief, the party in possession of the subject property is Jason Eric Morris and Patricia Jo Morris and the property is also known as 406 Gaines Loop Road, NE, Rome, GA 30161

The address and telephone number of the entity that has full authority to negotiate, amend, and modify all terms of the security deed with the debtor is: Family Savings Credit Union, 342 Marietta Highway, Hiram, Georgia 30141, 770-443-2655. Please understand that the secured creditor is not required by law to negotiate, amend, or modify the terms of the security deed.

The sale will be conducted subject (1) to confirmation that the sale is not prohibited under the U. S. Bankruptcy Code and (2) to final confirmation and audit of the status of the loan with the holder of the security deed.

EXHIBIT A

All that tract or parcel of land lying and being part of Land Lot 264 and/or 257 in the 24th District and 3rd Section of Floyd County, Georgia, and described as follows:

BEGINNING at the point where the Bells Ferry Road crosses the westerly right of way line of Southern Railway Company right of way, and running thence southwesterly, along the northwesterly railroad right of way line, approximately 384.7 feet to a point which is the TRUE POINT OF BEGINNING. Running thence from the TRUE POINT OF BEGINNING northeasterly along the northwesterly railroad right of way line, approximately 384.7 feet to the point where the Bells Ferry Road crosses the westerly right of way line of Southern Railway Company right of way; running thence southwesterly along the said Bells Ferry Road, approximately 370.11 feet to a point; running thence southeasterly from said point along a line 248.4 feet to the TRUE POINT OF BEGINNING. Said tract comprising one acre, more or less, and being a portion of the tract deeded by Quitclaim deed recorded at Deed Book 1608, Page 635, of the records of the Clerk of Superior Court of Floyd County, Georgia.

Grantee shall also have the right to take and use water from the present wells on lands now or once owned by J. L. McKellar and Pauline McKellar lying north of Bells Ferry Road, said wells located about 20 feet north of Bells Ferry Road.

Also conveyed hereby is the mobile home presently located on this property.
