By virtue of the power of sale contained in that certain Deed to Secure Debt from Betty L. Poole to The Bank of Soperton, dated December 4, 2009, filed on December 10, 2009, and recorded in Deed Book 128, pages 347-349, in the Office of the Clerk of the Superior Court of Treutlen County, Georgia, which secured a promissory note from Ricky Ray Poole, Perry L. Poole, and Betty L. Poole to The Bank of Soperton in the original principal amount of $14,167.50, there will be sold at public outcry for cash to the highest bidder before the courthouse doors of said county between the legal hours of sale on February 5, 2013, the first Tuesday of February, 2013, by Bank of Soperton, as Attorney-in-fact for Betty L. Poole, the following described property, to-wit:

All that certain tract or parcel of land, together with all improvements located thereon, situate, lying and being in the 1764th G. M. District of Treutlen County, Georgia, containing 11-acres, more or less, and is more particularly described as follows: Beginning at the southwestern corner of land of Noah A. Boyette, at which point Noah A. Boyette land adjoins land of Jim L. Gillis, Jr. and running thence along a straight line northwesterly for 776 feet to the property of Kelly Phillips, thence running westerly along the Kelly Phillips property line for 470 feet, more or less, to the run of a branch; thence running southeasterly along the run of said branch to the most southwestern property corner of Noah A. Boyette and Jim L. Gillis, Jr. property line for 687 feet, more or less, to the Point of Beginning. Said tract is the same tract conveyed to Lanier Poole and Betty L. Poole from Noah A. Boyette, by survivorship deed, recorded on July 20, 1979, in Deed Book 53, page 154, in the Office of the Clerk of the Superior Court of Treutlen County, Georgia.


(a) That certain 0.52 of an acre conveyed to Ricky Poole, by deed, dated August 1, 1990, and recorded in Deed Book 67, page 712, Treutlen County Deed Records.

(b) That certain 0.2471 of an acre conveyed to Treutlen County, by right-of-way deed, recorded on December 4, 2002, in Deed Book 99, page 486-491, Treutlen County Deed Records.

The indebtedness secured by said Deed to Secure Debt having been declared due and payable because of default in the payment of the indebtedness secured, thereby this sale will be made for the purpose of paying the same and all expenses of the sale, including attorney fees, notice of intention to collect attorney fees having been given as provided by law.

A copy of this legal advertisement (Notice of Sale Under Power) which was sent to The Soperton News has been mailed by certified mail, return receipt requested to Betty L. Poole, as required by Georgia law, O.C.G.A. 44-14-162.3.

The property will be sold as the property of Betty L. Poole, subject to the following: (1) all prior restrictive covenants, easements, right-of-ways, or encumbrances; (2) all valid zoning ordinances; (3) matters which would be disclosed by an accurate survey of the property; and (4) all outstanding taxes, assessments, unpaid bills, charges, and expenses that constitute liens against the property, whether due and payable or not yet due and payable.

To the best of the undersigned knowledge and belief, the party in possession is Betty L. Poole, tenants, or parties claiming under the aforementioned.
