By virtue of a Power of Sale contained in that certain Deed to Secure Debt from Ricky Sisk and Kim D. Sisk to Green Tree Financial Corp., dated June 2, 1998 and recorded in Deed Book 403, Page 287, in the Office of the Clerk of Superior Court of Habersham County, Georgia, as modified by that certain Loan Modification Agreement dated August 6, 1998 and recorded in Deed Book 410,Page 127, aforesaid records, said Deed to Secure Debt having been given to secure a Note dated, June 2, 1998, in the original principal amount of One Hundred Thousand Eight Hundred Thirty Seven and 00/100 Dollars ($100,837.00) with interest thereon as provided therein, having been last sold, assigned and transferred to U.S. Bank N.A., as Trustee on behalf of Manufactured Housing Contract Senior/Subordinate Pass-Through Certificate Trust 1998-6, will be sold at public outcry to the highest bidder for cash before the courthouse door of Habersham County, Georgia, within the legal hours of sale on the first Tuesday of December 2012, regarding the following described property:
All that tract or parcel of land lying and being in Land Lot 192, 10th Land District, Habersham County, Georgia, and being designated as Lot 5 of Newcastle Acres Subdivision, as shown on a plat dated May 27, 1997, recorded in Plat Book 42, Page 104, Habersham County records and incorporated herein; this is the same property conveyed by deed recorded in Deed Book 383, Page 327, said records.
Said property is commonly known as 160 Newcastle Dr., Alto, GA 30510 f/k/a Lot 5 New Castle Acr, Alto, GA 30540.
The indebtedness secured by said Deed to Secure Debt has been and is hereby declared due because of default under the terms of said Deed to Secure Debt and Note, including but not limited to the nonpayment of the indebtedness as and when due. The indebtedness remaining in default, this sale will be made for the purpose of paying the same, all expenses of the sale, including attorney fees and all other payments provided for under the terms of the Deed to Secure Debt and Note.
Said property will be sold subject to the following items which may affect the title of said property; zoning ordinances, matters which would be disclosed by an accurate survey or by an inspection of the property; any outstanding taxes, including but not limited to ad valorem taxes, which constitute liens upon said property; special assessments; all outstanding bills for public utilities which constitute liens upon said property; all restrictive covenants, easements, rights-of-way and any other matters of record superior to said Deed to Secure Debt. To the best of the knowledge and belief of the undersigned, the party in possession of the property is Ricky Sisk and Kim D. Sisk or tenant(s).
