NOTICE OF SALE UNDER POWER

Because of a default in the payment of the indebtedness secured by that certain Security Deed, dated April 24, 2001, executed by Georgia Trammell to Conseco Finance Servicing Corp., recorded in Deed Book 22V, Page 335, Wayne County, Georgia Deed Records, and securing a Note in the original principal amount of $42,931.78, said Security Deed last having been assigned to U.S. BANK, N.A, TRUSTEE ON BEHALF OF CONSECO FINANCE HOME EQUITY LOAN TRUST 2001-C, by Green Tree Servicing LLC, the current holder thereof, has declared the entire amount of said indebtedness evidenced by the Note immediately due and payable and, pursuant to the power of sale contained in said Security Deed, will, on the first Tuesday in March, 2013, to-wit: March 5, 2013, during the legal hours of sale, before the Wayne County Courthouse door, sell at public outcry to the highest bidder for cash, the following described real property:

All of that certain tract or parcel of land, together with the improvements thereon, situate, lying and being in Land Lot 32, Third Land District of Wayne County, Georgia, measuring 210' x 210' and being more particularly described as follows: Commencing at the Southwest land lot corner of Land Lot Number 32, thence, proceeding along the eastern boundary of a certain road which runs along the old Wayne County/ Appling County line and is now known as Killingsworth Road, North 13 degrees 0 minutes East for a distance of 513 feet to a point; thence, turning and running South 76 degrees 30 minutes East for a distance of 210 feet to the Point of Beginning; thence, continuing South 76 degrees 30 minutes East a distance of 210 feet to a point; thence, running North 13 degrees 0 minutes East a distance of 210 feet to a point; thence, running North 76 degrees 30 minutes West a distance of 210 feet to a point; thence, running South 13 degrees 0 minutes West as distance of 210 feet back to the POINT OF BEGINNING.

Said tract measures 210' by 210' and is the center one-third (1/3) of that certain parcel of land as shown on that certain plat prepared by W.P. Reddish, County Surveyor, dated May 7, 1959, and recorded in the Office of the Clerk of Wayne County Superior Court in Deed Book 89, Page 312. Reference is hereby made to said plat and the record thereof for further purposes of description.

Said property is bounded generally, now or formerly, as follows: Northeast 210 feet by property of James Knight; Southeast 210 feet by property of Thomas W. Kersey; Southwest 210 feet by property of Jake and Norman Williamson, a certain county-maintained road dividing; and Northwest 210 degrees by property of Thomas W. Kersey.

The above-described property is also known as 47 Evors Road, Jesup, Georgia 31545.

This sale will be conducted subject (1) to confirmation that the sale is not prohibited under the U.S. Bankruptcy Code and (2) to final confirmation and audit as to the amount and status of the loan with the holder of the Security Deed, including but not limited to, a determination that the borrower has not reinstated the loan prior to the foreclosure sale.

Upon information and belief, said real property is presently in the possession or control of GEORGIA TRAMMELL AND/OR OWEN TRAMMELL and the proceeds of said sale will be applied to the payment of said indebtedness and all the expenses of said sale, including attorney's fees, all as provided in said Security Deed and the excess proceeds, if any, will be distributed as provided by law.
