STATE OF GEORGIA<br /><br />COUNTY OF BALDWIN<br /><br />NOTICE OF SALE<br /><br />UNDER POWER<br /><br />Because of a default in<br /><br />the payment of the indebtedness<br /><br />secured by a<br /><br />Security Deed executed<br /><br />by Lucy R. Rozier to<br /><br />Mortgage Electronic Registration<br /><br />Systems, Inc. as<br /><br />nominee for Irwin Mortgage<br /><br />Corporation, and its<br /><br />successors and assigns<br /><br />dated July 29, 2003, and<br /><br />recorded in Deed Book<br /><br />663, Page 541, Baldwin<br /><br />County Records, said Security<br /><br />Deed having been<br /><br />last sold, assigned, transferred<br /><br />and conveyed to<br /><br />EverBank by Assignment,<br /><br />securing a Note in the<br /><br />original principal amount<br /><br />of $82,500.00, the holder<br /><br />thereof pursuant to said<br /><br />Deed and Note thereby<br /><br />secured has declared the<br /><br />entire amount of said indebtedness<br /><br />due and payable<br /><br />and, pursuant to the<br /><br />power of sale contained<br /><br />in said Deed, will on the<br /><br />first Wednesday, January<br /><br />2, 2013, during the legal<br /><br />hours of sale, before the<br /><br />Courthouse door in said<br /><br />County, sell at public outcry<br /><br />to the highest bidder<br /><br />for cash, the property described<br /><br />in said Deed,<br /><br />to-wit:<br /><br />All that lot, tract or parcel<br /><br />of land, together with the<br /><br />permanent improvements<br /><br />located thereon and connected<br /><br />therewith, the<br /><br />same situate, lying and<br /><br />being in the 5th Land District,<br /><br />322nd G.M.D., Baldwin<br /><br />County, Georgia,<br /><br />containing 4.71 acres,<br /><br />more or less, and being<br /><br />known and described as<br /><br />Lot Number Eleven (11),<br /><br />of Phase 1, Deer Ridge<br /><br />Subdivision as the same<br /><br />appears by reference to<br /><br />the official subdivision<br /><br />plat of survey, the same<br /><br />recorded in the Office of<br /><br />the Clerk of Superior<br /><br />Court of Baldwin County,<br /><br />Georgia, in Plat Book 23,<br /><br />Page 61, which plat is by<br /><br />this reference incorporated<br /><br />in aid of this description.<br /><br />This is a portion of that<br /><br />same property conveyed<br /><br />to G & G Land Sales, Inc.<br /><br />by Warranty Deed of<br /><br />Brian Keith Place dated<br /><br />June 19, 2002 and recorded<br /><br />in said Clerk's Office<br /><br />in Deed Book 589,<br /><br />Page 275.<br /><br />Subject To:<br /><br />1) The terms and conditions<br /><br />of those certain Protective<br /><br />Covenants for<br /><br />Deer Ridge Subdivision<br /><br />Phase 1 recorded in<br /><br />Deed Book 611, Pages<br /><br />7-, said records;<br /><br />2) The terms and conditions<br /><br />of those certain Protective<br /><br />Covenants set<br /><br />forth in Exhibit "B" of<br /><br />Deed Book 579, Pages<br /><br />89-92, said records;<br /><br />3) All easements of record;<br /><br />and<br /><br />4) Building set-back lines,<br /><br />general utility easements<br /><br />and other matters as may<br /><br />be disclosed on plats of<br /><br />record.<br /><br />There is or will be located<br /><br />on the property hereinabove<br /><br />described and conveyed<br /><br />a manufactured<br /><br />home more particularly<br /><br />described as a 2003<br /><br />General, 28' x 72', Model<br /><br />Cypress Pointe, bearing<br /><br />Serial Number<br /><br />GMHA4410229703AB,<br /><br />and by agreement of the<br /><br />parties hereto, is affixed<br /><br />to the above described<br /><br />land in such a manner as<br /><br />to constitute a fixture pursuant<br /><br />to O.C.G.A<br /><br />44-1-6(a), as amended,<br /><br />and has of the dated<br /><br />hereof become a part of<br /><br />the real property herein<br /><br />described. Accordingly,<br /><br />said home is to be<br /><br />treated and taxed as an<br /><br />improvement to real property<br /><br />for ad valorem tax<br /><br />purposes and the owner<br /><br />thereof agrees to apply<br /><br />for homestead exemption<br /><br />or take other applicable<br /><br />steps to ensure taxation<br /><br />of said home as real<br /><br />property at the earliest<br /><br />possible date under the<br /><br />laws of the State of Georgia.<br /><br />It being the unconditional<br /><br />and absolute intention<br /><br />that the manufactured<br /><br />housing as last described<br /><br />shall remain permanently<br /><br />attached in its<br /><br />place on the realty as<br /><br />hereinabove described.<br /><br />Said property is known as<br /><br />170 Hodges Lake Road,<br /><br />Gordon, GA 31031, together<br /><br />with all fixtures<br /><br />and personal property attached<br /><br />to and constituting<br /><br />a part of said property, if<br /><br />any.<br /><br />Said property will be sold<br /><br />subject to any outstanding<br /><br />ad valorem taxes (including<br /><br />taxes which are a<br /><br />lien, whether or not now<br /><br />due and payable), the<br /><br />right of redemption of any<br /><br />taxing authority, any matters<br /><br />which might be disclosed<br /><br />by an accurate<br /><br />survey and inspection of<br /><br />the property, any assessments,<br /><br />liens, encumbrances,<br /><br />zoning ordinances,<br /><br />restrictions,<br /><br />covenants, and matters<br /><br />of record superior to the<br /><br />Security Deed first set out<br /><br />above.<br /><br />The proceeds of said sale<br /><br />will be applied to the payment<br /><br />of said indebtedness<br /><br />and all expenses of<br /><br />said sale as provided in<br /><br />said Deed, and the balance,<br /><br />if any, will be distributed<br /><br />as provided by<br /><br />law.<br /><br />The sale will be conducted<br /><br />subject (1) to confirmation<br /><br />that the sale is<br /><br />not prohibited under the<br /><br />U.S. Bankruptcy Code<br /><br />and (2) to final confirmation<br /><br />and audit of the<br /><br />status of the loan with the<br /><br />secured creditor.<br /><br />The property is or may be<br /><br />in the possession of Lucy<br /><br />R.
