NOTICE OF SALE

UNDER POWER

Because of a default in

the payment of the indebtedness

secured by a

Security Deed executed

by Lucy R. Rozier to

Mortgage Electronic Registration

Systems, Inc. as

nominee for Irwin Mortgage

Corporation, and its

successors and assigns

dated July 29, 2003, and

recorded in Deed Book

663, Page 541, Baldwin

County Records, said Security

Deed having been

last sold, assigned, transferred

and conveyed to

EverBank by Assignment,

securing a Note in the

original principal amount

of $82,500.00, the holder

thereof pursuant to said

Deed and Note thereby

secured has declared the

entire amount of said indebtedness

due and payable

and, pursuant to the

power of sale contained

in said Deed, will on the

first Wednesday, January

2, 2013, during the legal

hours of sale, before the

Courthouse door in said

County, sell at public outcry

to the highest bidder

for cash, the property described

in said Deed,

to-wit:

All that lot, tract or parcel

of land, together with the

permanent improvements

located thereon and connected

therewith, the

same situate, lying and

being in the 5th Land District,

322nd G.M.D., Baldwin

County, Georgia,

containing 4.71 acres,

more or less, and being

known and described as

Lot Number Eleven (11),

of Phase 1, Deer Ridge

Subdivision as the same

appears by reference to

the official subdivision

plat of survey, the same

recorded in the Office of

the Clerk of Superior

Court of Baldwin County,

Georgia, in Plat Book 23,

Page 61, which plat is by

this reference incorporated

in aid of this description.

This is a portion of that

same property conveyed

to G & G Land Sales, Inc.

by Warranty Deed of

Brian Keith Place dated

June 19, 2002 and recorded

in said Clerk's Office

in Deed Book 589,

Page 275.

Subject To:

1) The terms and conditions

of those certain Protective

Covenants for

Deer Ridge Subdivision

Phase 1 recorded in

Deed Book 611, Pages

7-, said records;

2) The terms and conditions

of those certain Protective

Covenants set

forth in Exhibit "B" of

Deed Book 579, Pages

89-92, said records;

3) All easements of record;

and

4) Building set-back lines,

general utility easements

and other matters as may

be disclosed on plats of

record.

There is or will be located

on the property hereinabove

described and conveyed

a manufactured

home more particularly

described as a 2003

General, 28' x 72', Model

Cypress Pointe, bearing

Serial Number

GMHA4410229703AB,

and by agreement of the

parties hereto, is affixed

to the above described

land in such a manner as

to constitute a fixture pursuant

to O.C.G.A

44-1-6(a), as amended,

and has of the dated

hereof become a part of

the real property herein

described. Accordingly,

said home is to be

treated and taxed as an

improvement to real property

for ad valorem tax

purposes and the owner

thereof agrees to apply

for homestead exemption

or take other applicable

steps to ensure taxation

of said home as real

property at the earliest

possible date under the

laws of the State of Georgia.

It being the unconditional

and absolute intention

that the manufactured

housing as last described

shall remain permanently

attached in its

place on the realty as

hereinabove described.

Said property is known as

170 Hodges Lake Road,

Gordon, GA 31031, together

with all fixtures

and personal property attached

to and constituting

a part of said property, if

any.

Said property will be sold

subject to any outstanding

ad valorem taxes (including

taxes which are a

lien, whether or not now

due and payable), the

right of redemption of any

taxing authority, any matters

which might be disclosed

by an accurate

survey and inspection of

the property, any assessments,

liens, encumbrances,

zoning ordinances,

restrictions,

covenants, and matters

of record superior to the

Security Deed first set out

above.

The proceeds of said sale

will be applied to the payment

of said indebtedness

and all expenses of

said sale as provided in

said Deed, and the balance,

if any, will be distributed

as provided by

law.

The sale will be conducted

subject (1) to confirmation

that the sale is

not prohibited under the

U.S. Bankruptcy Code

and (2) to final confirmation

and audit of the

status of the loan with the

secured creditor.

The property is or may be

in the possession of Lucy

R. Rozier, successor in

interest or tenant(s).
