NOTICE OF SALE UNDER POWER

IN DEED TO SECURE DEBT



Under and by virtue of the power of sale contained in that certain Deed to Secure Debt from Brandon W. Robbins to Mortgage Electronic Registration Systems, Inc. as nominee for Pine State Mortgage Corporation in the original principal amount of $150,000.00 dated 07/31/2002, and recorded in Deed Book 1550, page 817, Bartow County records, said Security Deed being last transferred and assigned to U.S. Bank National Association in Deed Book 2555, page 30, Bartow County records, the undersigned will sell at public outcry to the highest bidder for cash before the Courthouse door in said County, during the legal hours of sale, on the first Tuesday of February, 2013 by U.S. Bank National Association, as Attorney-in-Fact for Brandon W. Robbins the following described property:



All that tract or parcel of land lying and being in Land Lot 1025, 21st District, 2nd Section, Bartow County, Georgia, and being a part of Lot 5, Columns Walk f/k/a Maddox Meadows, as per plat recorded at Plat Book 7A, page 45, Bartow County records, and being more particularly described as follows: Beginning at a point on the westerly right-of-way of Jacobs Road (having a 40 foot right-of-way) 364.28 feet southerly along said right-of-way from its intersection with the southerly right-of-way of Arrington Road (having a 40 foot right-of-way); running thence South 01 degrees 09 minutes 00 seconds West along the westerly right-of-way of Jacobs Road for a distance of 92.44 feet to an iron pin found on the common boundary line between Lots 4 and 5 of Columns Walk; running thence North 89 degrees 53 minutes 42 seconds West along the common boundary line between said Lots 4 and 5 for a distance of 246.65 feet to an iron pin found on the common boundary line between Lot 5 and property now or formerly owned by Durham; running thence North 00 degrees 58 minutes 08 seconds West along the common boundary line between Lot 5 and said Durham property for a distance of 100.00 feet to an iron pin found on the common boundary line between Lots 5 and 6 of Columns Walk; running thence South 88 degrees 09 minutes 23 seconds East (and leaving the common boundary line between said Lots 5 and 6) for a distance of 250.32 feet to a point on the westerly right-of-way of Jacobs Road and the Point of Beginning; being improved property known as 6367 Jacobs Road according to the present system of numbering houses in Bartow County; and being more particularly shown on that certain plat of survey prepared by David Bealle Surveyors, Ltd., David W. Bealle, Registered Land Surveyor No. 1872, dated November 20, 1995. Property known as: 6369 Jacobs Road, Acworth, GA 30102



The indebtedness secured by said Deed to Secure Debt having been declared due and payable because of default in the payment of the indebtedness secured thereby, this sale will be made for the purposes of paying the same and all expenses of sale, including attorney's fees, (notice having been given as provided by law).



The property will be sold as the property of The Aforesaid Grantors subject to the following:



(1) all prior restrictive covenants, easements, rights-of-way or encumbrances; (2) all valid zoning ordinances; (3) matters which would be disclosed by an accurate survey of the property; (4) the outstanding ad valorem taxes and assessments, if any; (5) unpaid water and sewage bills, that constitute liens against the property, whether due and payable or not yet due and payable; and (6) matters of record superior to the security deed first set out above.



Pursuant to O.C.G.A. Section 44-14-162.2 the name of the person or entity who has the full authority to negotiate, amend, or modify the terms of the aforementioned indebtedness is:
