NOTICE OF SALE UNDER POWER IN SECURITY DEED
Under and by virtue of the power of sale in that certain Deed to Secure Debt from Willie Clayton White, Jr. (hereinafter referred to as Grantor ) to The Heritage Bank, ( Grantee ), dated January 24, 2011 and recorded February 2, 2011 in Deed Book 505, Pages 333-343, Brantley County, Georgia records and Deed to Secure Debt from Glenn C. Hendrix and Willie C. White to the Satilla Community Bank n/k/a The Heritage Bank, dated April 10, 2007 and recorded on April 13, 2007 in Deed Book 401, Pages 43-48, Brantley County, Georgia records ( Security Deeds ), said Security Deeds secure a Promissory Note ( Note ), dated January 24, 2011, in the name of Willie Clayton White, Jr. in the original principal amount of $177,786.76 with interest from date thereon at the rate specified therein on the unpaid balance until paid, there will be sold by the undersigned at public outcry, during the legal hours of sale before the door of the courthouse of Brantley County, Georgia, on the first Tuesday in December , 2012, to wit, December 4, 2012, to the highest and best bidder for cash the following described property:
All that tract or parcel of land situate, lying and being in Land Lot No. 88 of the 2nd Land District of Brantley County, Georgia, consisting of 11,558 square feet, more or less, as shown and delineated upon a certain plat of survey made by Hugh D. Thomas, Georgia Registered Land Surveyor No. 1395, which plat is dated May 18, 1998, and recorded in Plat Book 19, page 165, in the office of the Clerk of the Superior Court of Brantley County, Georgia, and according to said plat is more particularly described as follows:
To find the point of beginning, located the point where the centerline of Cleveland Street intersects with the centerline of U.S. Highway 301; thence proceed South 44 degrees 57 minutes 46 seconds East for a distance of 53.90 feet to a point marked by a concrete monument; thence proceed South 42 degrees 16 minutes 34 seconds West for a distance of 50.52 feet to a point marked by a concrete monument; thence proceed South 20 degrees 15 minutes 23 seconds West for a distance of 126.63 feet to a point marked by a spike, which point is the POINT OF BEGINNING of the within described property. From said beginning point, thence proceed South 20 degrees 15 minutes 23 seconds West for a distance of 101.83 feet to a point marked by an iron pin; thence proceed North 80 degrees 13 minutes 13 seconds East for a distance of 154.69 feet to a point marked by an iron pin; thence proceed North 6 degrees 59 minutes 16 seconds West for a distance of 87.87 feet to a point marked by an iron pin; thence proceed south 80 degrees 25 minutes 36 seconds West for a distance of 108.0 feet to a point marked by a spike, which point is the Point of Beginning.
The plat of survey mentioned above is by reference incorporated herein and made a part of this description and deed.
TOGETHER WITH all the improvements erected on the property, and all easements, rights, appurtenances, rents, royalties, mineral, oil and gas rights and profits, water rights and stock, and all fixtures a part of the property, replacements and additions.
The indebtedness secured by said Security Deeds and Note has been and is hereby declared due and payable in full because of Grantor s failure to make payment of principal and interest required in the Note and the Security Deeds. Notice has been given of intention to enforce provisions for collection of attorney s fees and of foreclosure in accordance with legal requirements and the terms of the Security Deeds and Note. The indebtedness remaining in default, the sale will be made for the purpose of applying proceeds thereof to the payment of the indebtedness secured by the Security Deeds, accrued interest and expenses of the sale and other sums secured by the Security Deeds including attorney s fees, and the remainder, if any, shall be applied as provided by law.
To the best knowledge and belief of the undersigned the property will be sold as the property of Willie Clayton White, Jr. subject to outstanding ad valorem taxes, street improvements and other superior matters of record if any. The undersigned will execute a deed to the purchaser at said sale as provided in the Security Deeds.
