STATE OF GEORGIA COUNTY OF BULLOCH NOTICE OF SALE Because of default in the payment of a note secured by a DEED TO SECURE DEBT executed by FRANK W. EVANS to KELLY SMITH, dated February 27, 1987, recorded in Deed Book 478, Pages 715-716, Bulloch County Records, the undersigned has declared the full unpaid amount of the indebtedness referred to due and payable and, acting under the POWER OF SALE contained in said deed, for the purpose of paying said indebtedness, will on the first Tuesday in August, 2012, during the legal hours of sale at the courthouse in said county, sell at public outcry to the highest bidder for cash, the lands described in said deed, to-wit: All that certain tract or parcel of land lying and being in the 1716th GMD, Bulloch County, Georgia, which lot fronts southward on U. S. Highway 80 a distance of 50 feet and running back in a northerly direction to a street known as Mullett Row and bounded on the North by Mullett Row; East by lands now or formerly of John W. Johnson; South by the right of way of Highway 80; and on the West by lands now or formerly of John W. Johnson. LESS AND EXCEPT: a 15 foot strip of land conveyed by Warranty Deed from Mrs. Margaret L. Griffith to Apex Oil Company, Inc., dated November 8, 1960, and recorded in Deed Book 235, Page 448, Bulloch County Records. Said property is known as 27184 Hwy. 80 West, Portal, Bulloch County, Georgia, together with all fixtures and personal property attached to and constituting a part of said property, if any. Said property will be sold subject to any outstanding ad valorem taxes (including taxes which are a lien, whether or not now due and payable), the right of redemption of any taxing authority, any matters which might be disclosed by an accurate survey and inspection of the property, any assessments, liens, encumbrances, zoning ordinances, restrictions, covenants and matters of record superior to security deed held by the undersigned. The individual that has full authority to negotiate, amend, and modify all terms of the mortgage with the debtor is: Garry Smith, 208 Northside Drive West, Statesboro, Georgia, 912-536-1896. Please understand that the secured creditor is not required by law to negotiate, amend, or modify the terms of the mortgage instrument. Said property will be sold as the property of FRANK W. EVANS.
