STATE OF GEORGIA COUNTY OF GLYNN NOTICE OF SALE UNDER POWER By virtue of the power of sale contained in that certain Commercial Deed to Secure Debt and Security Agreement from Ray Richard to The Sea Palms Inn, Inc. ( PI , dated April 18, 2008, and recorded at Deed Book 2421, Page 302, Glynn County, Georgia records, which Security Deed was assigned by SPI to The Coastal Bank of Georgia ( oastal Bank , pursuant to that certain Transfer and Assignment of Deed to Secure Debt, dated April 18, 2008 and recorded at Deed Book 2421, Page 312, aforesaid records, and also assigned by SPI to Synovus Bank, pursuant to that certain Assignment of Deed to Secure Debt and Security Agreement, dated February 1, 2012, and recorded at Deed Book 2959, Page 119, aforesaid records, as further assigned by Synovus Bank, formerly known as Columbus Bank and Trust Company, as successor in interest through name change and by merger with Coastal Bank, to Sea Palms Partners, LLC, pursuant to that certain Assignment of Assignment of Deed to Secure Debt and Security Agreement, dated September 26, 2012 and recorded at Deed Book 3060, Page 7, aforesaid records (as assigned, hereinafter the ecurity Deed ; said Security Deed being given to secure indebtedness under that certain Balloon Promissory Note from Ray Richard to SPI, dated April 18, 2008, in the original principal amount of TWO HUNDRED SEVENTY SEVEN THOUSAND NINE HUNDRED EIGHTY AND NO/100 DOLLARS ($277,980.00), with interest on the unpaid balance from the date thereof until maturity or until paid, together with all other amounts payable with respect thereto, which Balloon Promissory Note was assigned by SPI to the Coastal Bank, pursuant to that certain Allonge dated April 18, 2008 and by SPI to Synovus Bank, pursuant to that certain Allonge dated February 1, 2012, as further assigned by Synovus Bank, formerly known as Columbus Bank and Trust Company, as successor in interest through name change and by merger with Coastal Bank, to Sea Palms Partners, LLC, pursuant to that certain Allonge dated September 26, 2012 (as assigned, hereinafter the ote ; there will be sold by the undersigned at public outcry to the highest bidder, for cash before the Courthouse door in Brunswick, Glynn County, Georgia, within the legal hours of sale on the first Tuesday in December, 2012, the property being more fully described as follows: ALL that certain condominium unit located on that certain parcel of land lying and being on St. Simons Island in Glynn County, Georgia, and being UNITS 116 AND 118, THE SEA PALMS INN CONDOMINIUMS, as shown on a plat dated August 12, 2007, prepared by Gary R. Nevill, GRLS No. 2401, recorded in Book 30, page 156 and Cabinet 2, No. 255 and 342, and the plans for Sea Palms Condominiums, prepared by Harrison Design Associates, dated August 16, 2007, recorded in Drawer VI, Plat No. 65F, in the records of Clerk of Superior Court in Glynn County, Georgia. Said Unit is a part of the property described in Schedule A to the Condominium Declaration recorded in Deed Book 2314, page 56, and amended and recorded in Deed Book 2387, page 227. The Unit includes an undivided percentage interest in the common areas and facilities of The Sea Palms Inn Condominiums, (as such common areas and facilities are defined in said Declaration), together with all of the right, title and interest of Grantor in said Unit and the appurtenances therein under said Declaration. The above described plat, the Declaration of Condominium, and all recorded amendments thereto are incorporated herein by reference and made a part hereof.
