STATE OF GEORGIA COUNTY OF GLYNN NOTICE OF SALE UNDER POWER Because of a default in the payment of the indebtedness secured by that certain Security Deed, dated March 10, 2009, executed by Susan Carver to MORTGAGE ELECTRONIC REGISTRATION SYSTEMS, INC. as nominee for Ameris Bank, recorded in Deed Book 2553, Page 420, Glynn County, Georgia Deed Records, and securing a Note in the original principal amount of $134,000.00, said Security Deed last having been assigned to Ocwen Loan Servicing, LLC, the current holder thereof, has declared the entire amount of said indebtedness evidenced by the Note immediately due and payable and, pursuant to the power of sale contained in said Security Deed, will, on the first Tuesday in December, 2012, to-wit: December 4, 2012, during the legal hours of sale, before the Glynn County Courthouse door, sell at public outcry to the highest bidder for cash, the following described real property: All that certain lot, tract or parcel of land situate, lying and being in Glynn County, Georgia, and in that certain subdivision therein known as "COUNTRY WALK shown upon a plat of said subdivision by Shupa Surveying Company, and signed by Gary R. Nevill, Georgia Registered Land Surveyor No. 2401, dated July 21, 2003, and recorded in the Office of the clerk of Superior Court of Glynn County, Georgia in Plat Drawer 29, Map No. 104A and 104B, as ALLOF LOT NUMBER ELEVEN (11), COUNTRY WALK SUBDIVISION, PHASE ONE (1). Reference is hereby made to said map and plan and the record thereof for all further purpose of identification, location and boundaries and all other purposes allowed by law. The aforedescribed real property is also known as 168 Country Walk Circle, Brunswick, GA 31525, according to the present system of numbering houses in Glynn County, Georgia. This sale will be conducted subject (1) to confirmation that the sale is not prohibited under the U.S. Bankruptcy Code and (2) to final confirmation and audit as to the amount and status of the loan with the holder of the Security Deed, including but not limited to, a determination that the borrower has not reinstated the loan prior to the foreclosure sale.
