NOTICE OF SALE UNDER POWER

Under and by virtue of the power of sale contained in a Security Deed from MISTY LANIER to UNITED COMMUNITY BANK, dated June 22, 2001, recorded June 22, 2001, in Deed Book Z-20, Page 463, Rabun County, Georgia records, as modified by Modification of Security Deed dated August 12, 2009, recorded in Deed Book J35, Page 292, Rabun County, Georgia records, said Security Deed being given to secure a Note from MISTY LANIER dated August 12, 2009, in the original principal amount of Twenty Two Thousand Six Hundred Eighty Five and 69/100 ($22,685.69) Dollars, with interest from date at a rate per cent per annum on the unpaid balance until paid; there will be sold by the undersigned at public outcry to the highest bidder for cash before the Courthouse door at Rabun County, Georgia, within the legal hours of sale on the first Tuesday in November, 2012, the following described property: All that tract or parcel of land lying and being in Land Lot 4 of the Third Land District of Rabun County, Georgia, and containing 2.93 acres, and being shown upon that certain plat of survey prepared by William F. Rolader, Georgia. Registered Land Surveyor No. 2042, dated May 1, 1991, revised May 8, 2001 and which is recorded in the Office of the Clerk of Rabun Superior Court in Plat Book 46, Page 95, said plat and the record of the same being incorporated herein by reference for a full and complete description of the property herein conveyed. The debt secured by said Security Deed has been and is hereby declared due because of, among other possible events of default, failure to pay the indebtedness as and when due and in the manner provided in the Note and Security Deed. The debt remaining in default, this sale will be made for the purpose of paying the same and all expenses of this sale, as provided in the Security Deed and by law, including attorney's fees (notice of intent to collect attorney's fees having been given). Said property will be sold subject to any outstanding ad valorem taxes (including taxes which are a lien, but not yet due and payable), any matters which might be disclosed by an accurate survey and inspection of the property, any assessments, liens, easements, encumbrances, zoning ordinances, restrictions, covenants, and matters of record superior to the Security Deed first set out above.
