NOTICE OF SALE
Because of a default in the payment of the indebtedness secured by a Security Deed executed by Christopher D. Ritchey to Mortgage Electronic Registration Systems, Inc. as nominee for Taylor, Bean & Whitaker Mortgage Corp., and its successors and assigns dated September 25, 2002, and recorded in Deed Book 972, Page 219, Tift County Records, said Security Deed having been last sold, assigned, transferred and conveyed to US Bank National Association, as Trustee, successor in interest to Wachovia Bank, National Association, as Trustee for GSMPS 2005-RP3 by Assignment, securing a Note in the original principal amount of $44,403.00, the holder thereof pursuant to said Deed and Note thereby secured has declared the entire amount of said indebtedness due and payable and, pursuant to the power of sale contained in said Deed, will on the first Tuesday, December 4, 2012, during the legal hours of sale, before the Courthouse door in said County, sell at public outcry to the highest bidder for cash, the property described in said Deed, to-wit:
All that tract or parcel of land lying and being in Land Lot 253, 7th Land District, Tift County, Georgia and being more particularly described as follows: TO OBTAIN THE POINT OF BEGINNING commence at the intersection of the south right of way line of U.S. Highway 82 (100 foot right of way) with the west right of way line of Oak Street (36 foot right of way) and travel southerly along the west right of way line of Oak Street 1,379.71 feet to the place and point of beginning of the tract herein described. From said beginning point travel South 01 degrees 38 minutes 30 seconds West 145.20 feet to a point; thence travel North 85 degrees 58 minutes 56 seconds West 104.62 feet to a point; thence travel North 01 degrees 06 minutes 10 seconds East 145.57 feet to a point; thence travel South 85 degrees 49 minutes 00 seconds East 106.00 feet to the place and point of beginning of the tract herein described. Said tract of land contains 0.351 acres and is more particularly delineated on that certain plat of survey entitled "Survey for Willie Mae Sumner" dated March 3, 1993 by Hampton & Associates Surveying Co. and recorded in Plat Book 24, Page 139, Public Records, Tift County, Georgia. Said plat and the description thereon are incorporated herein by reference thereto.
Said property is known as 156 South Pickett Street, Ty Ty, GA 31795, together with all fixtures and personal property attached to and constituting a part of said property, if any.
Said property will be sold subject to any outstanding ad valorem taxes (including taxes which are a lien, whether or not now due and payable), the right of redemption of any taxing authority, any matters which might be disclosed by an accurate survey and inspection of the property, any assessments, liens, encumbrances, zoning ordinances, restrictions, covenants, and matters of record superior to the Security Deed first set out above.
The proceeds of said sale will be applied to the payment of said indebtedness and all expenses of said sale as provided in said Deed, and the balance, if any, will be distributed as provided by law.
The sale will be conducted subject (1) to confirmation that the sale is not prohibited under the U.S. Bankruptcy Code and (2) to final confirmation and audit of the status of the loan with the secured creditor.
The property is or may be in the possession of Christopher D. Ritchey and Angelique J. Ritchey, successor in interest or tenant(s).
