NOTICE OF SALE UNDER POWER
Under and by virtue of the power of sale within a certain Security Deed from Cedrick Deon Binns, Grantor, to F&M Bank f/k/a Farmers and Merchants Bank, Grantee, dated August 24, 2007 and recorded in Deed Book 261, Page 69, Wilkes County Superior Court Deed Records. The subject Security Deed having been given to secure a Note dated December 4, 2008 in the original principal amount of $25,817.70, there will be sold by the undersigned at public outcry, during the legal hours of sale before the door of the Courthouse of Wilkes County, Georgia, on the first Tuesday in September, to wit, September 4, 2012, to the highest and best bidder for cash, the following described property:
ALL that tract or parcel of land lying and being within the 164th GMD of Wilkes County, Georgia, containing .59 acres, more or less, being bounded on the North by Harris Road; on the East by Nelm Street; on the South by land of Terrill Taylor; and on the West by lands of Nancy Madden, being designated as described as Lot 24, Section 1, Phase 3, as shown by plat of survey recorded in Plat Book 11, Page 254, being the same land conveyed by deed recorded in Deed Book 180, Page 88, Wilkes County Superior Court Deed Records.
The debt secured by the Security Deed and Note has been and is hereby declared due and payable in full because of default in payment pursuant to the terms of the Security Deed and Note. Notice has been given of intention to enforce provisions for collection of attorney's fees and foreclosure in accordance with legal requirements and the terms of the Security Deed and Note. The indebtedness remaining in default, the sale will be made for the purpose of applying proceeds thereof to the payment of the indebtedness secured by the Security Deed, accrued interest and expenses of the sale and other sums secured by the Security Deed, including attorney's fees; and, the remainder, if any, shall be applied as provided by law.
To the best of the undersigned's knowledge and belief the property is in the possession of Cedrick Deon Binns and said property will be sold as the property of said individual, subject to outstanding ad valorem taxes, street improvements, and easements or restrictions of record, if any.
