NOTICE OF SALE UNDER POWER

Under and by virtue of the power of sale within a certain Security Deed from Amanda H. Echols and Kelly R. Armour, Grantor, to F&M Bank f/k/a Farmers and Merchants Bank, Grantee, dated May 9, 2008 and recorded in Deed Book 268, Page 153, Wilkes County Superior Court Deed Records. The subject Security Deed having been given to secure a Note dated May 9, 2008 in the original principal amount of $30,844.00, there will be sold by the undersigned at public outcry, during the legal hours of sale before the door of the Courthouse of Wilkes County, Georgia, on the first Tuesday in February, to wit, February 5, 2013, to the highest and best bidder for cash, the following described property:

ALL that tract or parcel of land with improvements thereon, situate, lying and being in the 169th GMD of Wilkes County, Georgia, and fronting on the South side of Georgia Highway 44, and containing 1.5 acres, more or less, and being more particularly described by a plat of survey prepared by Neill Echols, RLS, dated October 17, 2007 and recorded in Plat Book 12, Page 485, Wilkes County Superior Court Deed Records. Said plat of survey and the official record thereof is incorporated herein for a more complete description of said tract.

Said tract is bounded now or formerly as follows: North by Georgia Highway 44; East by lands of Hoyt S. Power; and South and West by lands of John Hunter.

This is that same tract acquired by Amanda H. Echols from Susan R. Power by deed dated November 9, 2007 and recorded in Deed Book 263, Page 246, Wilkes County Superior Court Deed Records.

Also included is a 1997 General 28x52 Mobile Home, ID #GMHGA3249612179A&B.

The debt secured by the Security Deed and Note has been and is hereby declared due and payable in full because of default in payment pursuant to the terms of the Security Deed and Note. Notice has been given of intention to enforce provisions for collection of attorney's fees and foreclosure in accordance with legal requirements and the terms of the Security Deed and Note. The indebtedness remaining in default, the sale will be made for the purpose of applying proceeds thereof to the payment of the indebtedness secured by the Security Deed, accrued interest and expenses of the sale and other sums secured by the Security Deed, including attorney's fees; and, the remainder, if any, shall be applied as provided by law.

To the best of the undersigned's knowledge and belief the property is in the possession of Amanda H. Echols and Kelly R. Armour and said property will be sold as the property of said individual(s), subject to outstanding ad valorem taxes, street improvements, and easements or restrictions of record, if any.

THIS LAW FIRM IS ACTING AS DEBT COLLECTOR ATTEMPTING TO COLLECT A DEBT. ANY INFORMATION OBTAINED WILL BE USED FOR THAT PURPOSE.
