NOTICE OF SALE
By virtue of the power of sale contained in that certain Deed to Secure Debt from Virginia C. Johnson ( ebtor to C & C Home Improvements ( ender , dated November 10, 2005, and recorded November 28, 2005 in Deed Book 14T, Page 729-733; and assigned at Deed Book 14T, Page 734; and further assigned at Deed Book 16D, Page 124-25 Telfair County, Georgia records and said Deed to Secure Debt having been given to secure a Note dated November 10, 2005 in the original principal sum of Thirteen Thousand Six Hundred Thirty and 00/100 ($13,630.00) Dollars, with interest from date at the rate stated in said Note on the unpaid balance until paid, there will be sold by the undersigned at public outcry to the highest bidder for cash before the Courthouse door at Telfair County, Georgia, with the legal hours of sale on the first Tuesday in July, 2012, the property described as follows:
All that tract or parcel of land lying and being in Telfair County, Georgia, and being more particularly described as follows: Beginning at a stake corner to Jim Elder in the property line on the west side of 6th Avenue and running thence in a westerly direction a distance of 200 feet to a stake corner to Jim Elder, thence running in a southerly direction a distance of 50 feet to a stake corner to Jim Elder and one Perry and Ella Maddox, running thence in a westerly direction a distance of 200 feet to a stake in the property line on the east side of an unnamed avenue, thence running in a northerly direction, along the line on the east side of the unnamed avenue to a stake marking the intersection of the said property line on the east side of the unnamed avenue, with the line dividing the city of McRae and the city of Helena, thence running in a northeasterly direction, along the said line dividing the city of McRae and the city of Helena, to a stake marking the intersection of said line with the property line of land owned by the Merchants & Citizens Bank, now owned by Fannie Cummings, thence running in an easterly direction, along the line of Fannie Cummings, a distance of approximately 375 feet to a stake in the property line on the west side of 6th avenue, thence running in a southerly direction, along the property line on the west side of 8th avenue, to the beginning point, lying and being in the city of McRae, Telfair County, Georgia, and being in the 10th Land District of said county, and part of Lot no. 188, and bounded as follows: on the north by lands of Fannie Cummings, on the east by 6th Avenue, on the south by lands of Jim Elder and One Perry, and on the west by an unnamed avenue, and the city of Helena, the above description was an accurate description of the aforesaid property as of October 4, 1949, and, there is specifically saved and excepted out of the aforesaid property that property heretofore deeded by Fannie Cummings to Claudine Cummings by Warranty Deed dated June 12, 1965, which is recorded in the Office of the Clerk of Telfair Superior Court in Deed Book 4-W, Page 288, said deed being incorporated herein and made a part hereof by reference. This being the identical lands described in and conveyed by that certain deed from Virginia Johnson and Lewis Johnson to E C. Ryals, III dated August 31, 1968, and recorded in Deed Book 5-D, Pages 732-3, Telfair County records.
Subject to restrictions, reservation, easements, covenants, oil, gar, or mineral rights of record, if any.
The debt secured by said Deed to Secure Debt has been and is hereby declared due because of, among other possible events of default, non-payment of the monthly installments on said loan. The debt remaining in default, this sale will be made for the purpose of paying the same and all expenses of this sale, including attorney fees.
Said property will be sold as the property of Virginia C. Johnson ( ebtor , subject to a prior deed to secure debt in favor of C & C Homes Improvements ( ender recorded at Deed Book 14T, Page 729-733; and assigned at Deed Book 14T, Page 734; and further assigned at Deed Book 16D, Page 124-25 Telfair County, Georgia Telfair County, Georgia records, to the outstanding ad valorem taxes and/or assessments, if any, and all easements and restrictions of record, if any, having priority over this Deed to Secure Debt.
