STATE OF GEORGIACOUNTY OF DOUGHERTY Under and by virtue of the Power of Sale in a certain Deed to Secure Debt from Yang Yueh Yin, Grantor, to Metro City Bank, Grantee, dated November 25, 2009; recorded in Deed Book 3678, page 27, Dougherty County, Georgia records; said Deed to Secure Debt having been given to secure a Promissory Note dated November 25, 2009, in the original principal amount of $500,000.00; there will be sold by the undersigned at public outcry, during the legal hours of sale, before the door of the courthouse of Dougherty County, Georgia, on the first Tuesday in September, 2012 to wit: September 4, 2012, to the highest and best bidder for cash, the following described property: ALL THAT CERTAIN PARCEL OF LAND designated as Tracts 1 and 3, being part of Land Lot 268 in the First Land District of Dougherty County, Georgia, as shown and designated on a map of plat of the Shackelford Place, East Albany, being redivisions of Blocks D and E; said plat dated February 4, 1958, and recorded in Plat Book 3, page 11, in the Office of the Clerk of Superior Court of Dougherty County, Georgia. The above described property is presently improved with a permanent structure formerly knows as the "Howard Johnson Restaurant". Excepted from the above described property is a 10 foot wide, even width strip of property off of the extreme eastern side of Tract 1 and Tract 3 as shown and designated in Plat Book 3, page 11, aforesaid records, and strip being parallel to and contiguous with Tracts 2 and 4 as shown in said plat. This excepted property was earlier deed by Warranty Deed from Trading Company to David Shapiro, and deed being recorded on July 2, 1958, in Deed Book 220, page 518, in the Office of the Clerk of Superior Court of Dougherty County, Georgia. The debt secured by said Deed to Secure Debt and Note has been and is hereby declared due and payable in full because of a default in payments not having been made pursuant to the terms of said Deed to Secure Debt and Note. Notice has been given of intention to enforce provisions for collection of attorneys' fees and foreclosure in accordance with legal requirements and the terms of the Deed to Secure Debt and Note. The indebtedness remaining in default, the sale will be made for the purpose of applying proceeds thereof to the payment of the indebtedness secured by the Deed to Secure Debt, accrued interest and expenses of the sale and other sums secured by the Deed to Secure Debt including attorneys' fees, and the remainder, if any, shall be applied as provided by law.
