NOTICE OF SALE UNDER POWER Under and by virtue of the power of sale contained in a Security Deed, dated July 10, 2008, executed by DANNY E. WELLHAM to U S CAPITAL CORPORATION and recorded in Deed Book 46968, Page 579, Fulton County, Georgia Records, securing a Note in the original principal amount of $35,000., the undersigned will sell at public outcry during the legal hours of sale before the door of the Courthouse in Fulton County, Georgia, on December 7, 2010, to the highest bidder for cash the following described property:

ALL THAT TRACT OR PARCEL OF LAND LYING AND BEING IN LAND LOT 71 OF THE 14TH DISTRICT OF ORIGINALLY HENRY, NOW FULTON COUNTY, GEORGIA, AND BEING LOT 17, BLOCK "F," ACCORDING TO A PLAT OF LAKEWOOD PARK SUBDIVISION MADE BY C. D. ROBERTS, C.E., COUNTY SURVEYOR, DATED MAY 1941, RECORDED IN PLAT BOOK 24, PAGE 22, FULTON COUNTY, GEORGIA RECORDS; AND BEING MORE PARTICULARLY DESCRIBED AS FOLLOWS:

BEGINNING AT THE SOUTHWEST CORNER OF SAID LOT 17, BLOCK "F," AND RUNNING EAST ALONG LAKEWOOD AVENUE 97.6 FEET TO A POINT; THENCE NORTH 182.52 FEET TO A POINT; THENCE SOUTHWESTERLY 98.07 FEET TO A POINT; THENCE SOUTH 190.15 FEET TO THE POINT OF BEGINNING; TOGETHER WITH ALL IMPROVEMENTS THEREON, SUBJECT TO EASEMENT FOR SIDEWALK ON LAKEWOOD AVENUE.

The debt secured by said Security Deed and evidenced by said Note has been and is hereby declared due and payable because of grantor's failure to make monthly payments, among other defaults. This sale will be made for the purpose of paying said indebtedness, including all accrued and unpaid interest, expenses of sale, including attorney's fees (notice of intention to collect attorney's fees having been given), and other charges, if any. The Property will be sold as the property of Lakewood Avenue with a parcel ID of 14-0071-0002-094-6. To the best of the undersigned's knowledge and belief, the party in possession is Danny E. Wellham or a tenant or tenants. Said property will be sold subject to any and all unpaid property taxes, water bills, assessments, all restrictions, easements and liens of record, if any, and all matters that would be disclosed by a survey.
