WM5013 NOTICE OF SALE UNDER POWER IN SECURITY DEED Whereas, on December 27, 2002, Deborah Evans, Marvin B. Evans and Robert M. Evans executed and delivered a certain security deed to Citizens Bank & Trust, Inc. for the purpose of securing the indebtedness therein described, which security deed appears of record in Deed Book 1135 Page 598, Walker County, Georgia Land Records, reference to which deed is hereby made for its full terms, provisions and conditions; and Whereas, the debt secured by said security deed has become in default as to the principal and interest, and the holder thereof has declared the entire indebtedness owing thereby at once immediately due and payable. Now therefore, pursuant to the terms, provisions, and conditions of the aforesaid security deed and the laws in such cases made and provided, the undersigned will offer for sale and will sell for cash on the first Tuesday in September to wit: September 4, 2012, between the legal hours of sale at public outcry before the courthouse door in Walker County, Georgia, the property described in said security deed, which is more particularly described as follows: All that tract or parcel of land lying and being in Land Lot No. 195 in the 10th District and 4th Section of Walker County, Georgia and being more particularly described as follows: Beginning at a corner on the Paynes Chapel Road, 375 feet southeasterly of the intersection of said road and the north line of Land Lot No. 195; thence northeasterly 217 feet to an iron pipe; thence south 285 feet, more or less, to an iron pipe in the Paynes Chapel Road a/k/a Middle Road; thence northwesterly along said road, 175 feet, more or less, to the point of beginning. Said property will be sold subject to all outstanding and unpaid ad valorem taxes, assessments, liens, encumbrances, zoning ordinances, restrictions, covenants, lien for unpaid utility bills, and other matters of record superior, if any, to the Security Deed. This property will be sold at public outcry to the highest and best bidder for cash in bar of all equity of redemption by Marvin B. Evans, Deborah Evans, and Robert M. Evans, and assigns; and will be sold as the property of Marvin B. Evans, Deborah Evans, and Robert M. Evans , the maker of the aforesaid security deed to Citizens Bank & Trust, Inc.; and the said sales proceeds shall be used first to the payment of said note, principal, interest and expenses, and the balance, if any, delivered to the said Marvin B.
