Under and by virtue of the power of sale contained in that certain Deed to Secure Debt from Barbara Maxine Thomison a/k/a Barbara Thomison to Mortgage Electronic Registration Systems, Inc. as nominee for America`s Wholesale Lender in the original principal amount of $75,000.00 dated 04/30/2003, and recorded in Deed Book 1164, page 275, Walker County records, said Security Deed being last transferred and assigned to Bank of America, N.A., successor by merger to BAC Home Loans Servicing, LP, fka Countrywide Home Loans Servicing, LP in Deed Book 1724, page 197, Walker County records, the undersigned will sell at public outcry to the highest bidder for cash before the Courthouse door in said County, during the legal hours of sale, on the first Wednesday of January, 2013 by Bank of America, N.A., as Attorney-in-Fact for Barbara Maxine Thomison a/k/a Barbara Thomison the following described property:
All that tract or parcel of land lying and being in Original Land Lot No. 256 in the Ninth(9) District and Fourth(4) Section of Walker County, Georgia, being described as follows: Beginning at a point on the south line of Grand Center Road where the same is intersected by the east line of said Land Lot No. 256; thence South 01 degree 30 minutes East, along the east line of said Land Lot, a distance of 109 feet to an iron stake; thence South 88 degrees 30 minutes West a distance of 100 feet to an iron stake; thence North 01 degrees 30 minutes West a distance of 109 feet to an iron stake located on the south line of said Grand Center Road; thence North 88 degrees 30 minutes East, along the south line of said Grand Center Road, a distance of 100 feet to the Point of Beginning.
Being the same property conveyed to Barbara Maxine Thomison by deed from Barbara Thomison, Executor under the Last Will and Testament of Donald Lee Thomison, deceased, dated 06/21/2002, and recorded 06/24/2002 in Book 1097, Page 87, in the Office of the Clerk of the Superior Court for Walker County, Georgia.
Property known as: 2267 Grand Center Road, Chickamauga, GA 30707
The indebtedness secured by said Deed to Secure Debt having been declared due and payable because of default in the payment of the indebtedness secured thereby, this sale will be made for the purposes of paying the same and all expenses of sale, including attorney's fees, (notice having been given as provided by law).
The property will be sold as the property of The Aforesaid Grantors subject to the following:
(1) all prior restrictive covenants, easements, rights-of-way or encumbrances; (2) all valid zoning ordinances; (3) matters which would be disclosed by an accurate survey of the property; (4) the outstanding ad valorem taxes and assessments, if any; (5) unpaid water and sewage bills, that constitute liens against the property, whether due and payable or not yet due and payable; and (6) matters of record superior to the security deed first set out above.
Bank of America, N.A. holds the duly endorsed Note and is the current assignee of the Security Deed to your property.
