NOTICE OF SALE UNDER POWER IN DEED TO SECURE DEBT

Under and by virtue of the power of sale contained in that certain Deed to Secure Debt from Phyllis Love and Steven Love to Mortgage Electronic Registration Systems, Inc. as nominee for Home America Mortgage, Inc. in the original principal amount of $82,000.00 dated 05/28/2002, and recorded in Deed Book 1092, page 733, Walker County records, said Security Deed being last transferred and assigned to CitiMortgage, Inc. in Deed Book 1735, page 575, Walker County records, the undersigned will sell at public outcry to the highest bidder for cash before the Courthouse door in said County, during the legal hours of sale, on the first Wednesday of January, 2013 by CitiMortgage, Inc., as Attorney-in-Fact for Phyllis Love and Steven Love the following described property:

All that tract or parcel of land lying and being in Land Lot No. 52 in the 26th District and 3rd Section of Walker County, Georgia, containing 2.63 acres, and described as follows: Beginning at an iron pin on the West line of said Land Lot No. 52, 1969.71 feet North of the Southwest corner of said land lot; thence North 1 degree 12 minutes 36 seconds East along the West line of said Land Lot, 192.85 feet to an iron pin; thence South 89 degrees 23 minutes 41 seconds East 600 feet; thence South 1 degree 13 minutes 28 seconds West 189.26 feet; thence North 89 degrees 44 minutes 12 seconds West 600 feet to the point of beginning. Together with an Easement 20 feet in width for purpose of ingress and egress to and from the above-described property, said easement beginning at the Northeast corner of the above-described tract and running thence South 89 degrees 23 minutes 41 seconds East 706.69 feet to an iron pin on the Westerly side of Mill Creek Road; thence South 12 degrees 38 minutes 12 seconds West along the Westerly side of Mill Creek Road 20.44 feet; thence North 89 degrees 23 minutes 41 seconds West 702.64 feet to the East line of the above-described tract; thence North 1 degree 13 minutes 28 seconds East 20 feet to the point of beginning.

The indebtedness secured by said Deed to Secure Debt having been declared due and payable because of default in the payment of the indebtedness secured thereby, this sale will be made for the purposes of paying the same and all expenses of sale, including attorney's fees, (notice having been given as provided by law).

The property will be sold as the property of The Aforesaid Grantors subject to the following:

(1) all prior restrictive covenants, easements, rights-of-way or encumbrances; (2) all valid zoning ordinances; (3) matters which would be disclosed by an accurate survey of the property; (4) the outstanding ad valorem taxes and assessments, if any; (5) unpaid water and sewage bills, that constitute liens against the property, whether due and payable or not yet due and payable; and (6) matters of record superior to the security deed first set out above.
