Under and by virtue of the power of sale contained with that certain Deed to Secure Debt dated October 8, 2008, from William Walston and Sheila Walston to JPMorgan Chase Bank, N.A., recorded on October 29, 2008 in Deed Book 1578 at Page 583, Walker County, Georgia Records, having been last sold, assigned, transferred and conveyed to JPMorgan Chase Bank, National Association by Assignment and said Deed to Secure Debt having been given to secure a note dated October 8, 2008, in the amount of $86,598.00, said note being in default, the undersigned will sell at public outcry during the legal hours of sale before the door of the courthouse of Walker County, Georgia, on January 2, 2013, the following described real property (hereinafter referred to as the "Property"): ALL THAT TRACT OR PARCEL OF LAND LYING AND BEING IN LAND LOT 66 IN THE 26TH DISTRICT AND 3RD SECTION OF WALKER COUNTY, GEORGIA DESCRIBED AS FOLLOWS: TO FIND THE POINT OF BEGINNING, START AT THE NORTHEAST CORNER OF SAID LAND LOT 66, MARKED BY A CONCRETE MONUMENT, THENCE SOUTH ALONG THE EAST LINE OF SAID LAND LOT A DISTANCE OF 206.5 FEET TO AN IRON PIPE AND THE POINT OF BEGINNING; THENCE SOUTH 01 DEGREE 16 MINUTES 26 SECONDS EAST ALONG THE EAST LINE OF SAID LAND LOT, A DISTANCE OF 210.0 FEET TO AN IRON PIN; THENCE NORTH 89 DEGREES 49 MINUTES 14 SECONDS WEST ALONG THE NORTHERN LINE OF PROPERTY NOW OR FORMERLY OWNED BY DILLIE G. BRYANT, A DISTANCE OF 224.35 FEET TO AN IRON PIPE IN THE EASTERN RIGHT OF WAY LINE OF NORTH DIC CREEK ROAD; THENCE NORTH 04 DEGREES 01 MINUTES 00 SECONDS WEST ALONG THE EASTERN RIGHT OF WAY LINE OF NORTH DICK CREEK ROAD A DISTANCE OF 147.43 FEET; THENCE CONTINUING ALONG THE EASTERN RIGHT OF WAY OF NORTH DICK CREEK ROAD, NORTH 01 DEGREES 18 MINUTES 08 SECONDS WEST; A DISTANCE OF 62.57 FEET TO AN IRON PIPE IN THE SOUTHWESTERN CORNER OF PROPERTY NOW OR FORMERLY OWNED BY DENNIS ALEXANDER AND BONNIE ALEXANDER, THENCE SOUTH 89 DEGREES 54 MINUTES 21 SECONDS EAST, ALONG THE SOUTHERN LINE OF SAID ALENXANDER PROPERTY, A DISTANCE OF 231.43 FEET TO AN IRON PIPE AND THE POINT OF BEGINNING. The debt secured by the Security Deed and evidenced by the note and has been, and is hereby, declared due and payable because of, among other possible events of default, failure to make the payments as required by the terms of the Note. The debt remaining is in default and this sale will be made for the purposes of paying the Deed to Secure Debt, accrued interest, and all expenses of the sale, including attorneys' fees. Notice of intention to collect attorneys' fees has been given as provided by law. To the best of the undersigned's knowledge, the person(s) in possession of the property is/are William Walston and Sheila Walston. The property, being commonly known as 1847 N Dick Creek Road, Lafayette, GA 30728 in Walker County, will be sold as the property of William Walston and Sheila Walston, subject to any outstanding ad valorem taxes (including taxes which are a lien and not yet due and payable), any matters affecting title to the property which would be disclosed by accurate survey and inspection thereof, and all assessments, liens, encumbrances, restrictions, covenants, and matters of record to the Security Deed.
