Under and by virtue of the power of sale contained with that certain Deed to Secure Debt dated March 31, 2006, from Grady Bettis and Carolyn Morgan to Long Beach Mortgage Company, recorded on April 5, 2006 in Deed Book 1402 at Page 411, Walker County, Georgia Records, having been last sold, assigned, transferred and conveyed to Deutsche Bank National Trust Company, as Trustee for Long Beach Mortgage Loan Trust 2006-4 by Assignment and said Deed to Secure Debt having been given to secure a note dated March 31, 2006, in the amount of $87,600.00, said note being in default, the undersigned will sell at public outcry during the legal hours of sale before the door of the courthouse of Walker County, Georgia, on January 2, 2013, the following described real property (hereinafter referred to as the "Property"): ALL THAT TRACT OR PARCEL OF LAND LYING AND BEING IN ORIGINAL LAND LOT NO. 151 IN THE 9TH DISTRICT AND 4TH SECTION OF WALKER COUNTY, GEORGIA BEING KNOWN AND DESIGNATED AS LOT NO . THIRTY-TWO (32) OF RIDGEFIELD ESTATES, AS SHOWN BY PLAT OF SAID SUBDIVISION OF RECORD IN PLAT BOOK 8, PAGE 148, IN THE OFFICE OF THE CLERK OF THE SUPERIOR COURT OF WALKER COUNTY, GEORGIA. SUBJECT TO RESTRICTIONS OF RECORD IN DEED BOOK 447, PSHR 264, WALKER COUNTY, GEORGIA DEED RECORDS. SUBJECT TO DRAIN AND UTILITY EASEMENT ON ALL SIDE AND REAR LOT LINES AS SHOWN ON RECORDED PLAT 8, PAGE 148. BEING THE SAME PROPERTY CONVEYED FROM MARK ANDREW GRANLUND, SR. AND ELIZABETH MCHEARG GRANLUND TO EDWARD A. JONES AND WIFE, ELIZABETH P. JONES AS SHOWN ON WARRANTY DEED RECORDED JULY 1, 1994 IN BOOK 739 PAGE 483 IN THE OFFICE OF THE CLERK OF THE SUPERIOR COURT OF WALKER COUNTY, GEORGIA. BEING THE SAME PROPERTY CONVEYED FROM ELIZABETH P. JONES TO EDWARD A. JONES AS SHOWN ON QUIT CLAIM DEED RECORDED AUGUST 1, 2005 IN BOOK 1347 PAGE 284 IN TE OFFICE OF THE CLERK OF THE SUPERIOR COURT OF WALKER COUNTY, GEORGIA. The debt secured by the Security Deed and evidenced by the note and has been, and is hereby, declared due and payable because of, among other possible events of default, failure to make the payments as required by the terms of the Note. The debt remaining is in default and this sale will be made for the purposes of paying the Deed to Secure Debt, accrued interest, and all expenses of the sale, including attorneys' fees. Notice of intention to collect attorneys' fees has been given as provided by law. To the best of the undersigned's knowledge, the person(s) in possession of the property is/are Grady Bettis and Carolyn Morgan. The property, being commonly known as 2004 David Lane, Rossville, GA 30741 in Walker County, will be sold as the property of Grady Bettis and Carolyn Morgan, subject to any outstanding ad valorem taxes (including taxes which are a lien and not yet due and payable), any matters affecting title to the property which would be disclosed by accurate survey and inspection thereof, and all assessments, liens, encumbrances, restrictions, covenants, and matters of record to the Security Deed.
