NOTICE OF SALE UNDER
Because of a default in the payment of the indebtedness secured by a Security Deed executed by James A. Wood and Deena M. Wood to United Community Mortgage Services, Inc. dated November 30, 2004, and recorded in Deed Book 986, Page 60, White County Records, said Security Deed having been last sold, assigned, transferred and conveyed to JPMorgan Chase Bank, National Association by Assignment, securing a Note in the original principal amount of $200,000.00, the holder thereof pursuant to said Deed and Note thereby secured has declared the entire amount of said indebtedness due and payable and, pursuant to the power of sale contained in said Deed, will on the first Tuesday, February 5, 2013, during the legal hours of sale, before the Courthouse door in said County, sell at public outcry to the highest bidder for cash, the property described in said Deed, to-wit:
All that tract or parcel of land lying and being in Land Lot 32 of the 2nd Land District of White County, Georgia, containing 1.49 acres, more or less, and being all of Lot R-11 of the Long Ridge Subdivision, as designated and delineated on Plat of Survey dated March 13, 1987, prepared by Eddie Hood, County Surveyor, White County, Georgia, recorded in Plat Book 19, page 38, Office of Clerk, Superior Court, White County, Georgia. Reference is hereby made to said Plat of Survey and the record thereof for a more complete description of said property.
SUBJECT TO Protective Covenants set forth in instrument dated March 13, 1985, recorded in Deed Book 7-F, pages 166-171, said Clerk s Office.
SUBJECT TO Protective Covenants for Long Ridge Subdivision dated May 1, 1986, recorded in Deed Book 22, pages 148-150, said Clerk s Office, and rerecorded in Deed Book 62, pages 151-155, said Clerk s Office.
SUBJECT TO those amendments to the aforesaid Protective Covenants, of record in said Clerk s Office, which affect the above-described property.
SUBJECT TO the 50-foot road easement for the Daybreak Road shown on the above-referenced Plat of Survey.
SUBJECT TO existing easements for public utilities.
ALSO CONVEYED is an easement for ingress and egress via the subdivision road known as Daybreak Road, and its attendant right-of-way easement, extending in a Westerly and Southerly direction from the Westerly right-of-way of U. S. Highway 129 to and along the above-described property.
Said property being the same property described and conveyed in Warranty Deed dated July 27, 1995, executed by Daybreak, Inc. to Gene Andrews and Dianne G. Andrews, recorded in Deed Book 435, page 471, said Clerk s Office.
Said property is known as 1367 Daybreak Road, Cleveland, GA 30528, together with all fixtures and personal property attached to and constituting a part of said property, if any.
Said property will be sold subject to any outstanding ad valorem taxes (including taxes which are a lien, whether or not now due and payable), the right of redemption of any taxing authority, any matters which might be disclosed by an accurate survey and inspection of the property, any assessments, liens, encumbrances, zoning ordinances, restrictions, covenants, and matters of record superior to the Security Deed first set out above.
The proceeds of said sale will be applied to the payment of said indebtedness and all expenses of said sale as provided in said Deed, and the balance, if any, will be distributed as provided by law.
The sale will be conducted subject (1) to confirmation that the sale is not prohibited under the U.S. Bankruptcy Code and (2) to final confirmation and audit of the status of the loan with the secured creditor.
The property is or may be in the possession of James A. Wood and Deena M. Wood, successor in interest or tenant(s).
