By virtue of the Power of Sale contained in that Security Deed executed and delivered by Yonah Walls & Ceilings, Inc. to Regions Bank, dated March 5, 2007, and recorded in Deed Book 1174, Page 401, as modified by that certain Modification of Security Deed dated October 1, 2007, recorded in Deed Book 1235, Page 108, as affected by that certain Scrivener s Affidavit by K. Grant Keene, dated January 14, 2008, recorded in Deed Book 1235, Page 310, White County Records, conveying the after-described property to secure a Note in the original principal amount of One Hundred Forty-One Thousand Eight Hundred Dollars and 0/00 ($141,800.00) with interest thereon as set forth therein, there will be sold at public outcry before the Courthouse door in said County by Regions Bank, during the legal hours of sale on the first Tuesday in December, 2012, to the highest bidder for cash, the following described property, as follows:
ALL THAT TRACT OR PARCEL OF LAND LYING AND BEING IN LAND LOT 58 OF THE 2ND LAND DISTRICT OF WHITE COUNTY, GEORGIA, AND IN THE CITY OF CLEVELAND, GEORGIA, AND BEING ALL OF LOT 13 (CONTAINING 0.562 ACRE, MORE OR LESS), OF WOODLAND FOREST, PHASE ONE, A SUBDIVISION, AS DELINEATED ON PLAT OF SURVEY DATED SEPTEMBER 21, 1998, REVISED OCTOBER 13, 1998, OF WOODLAND FOREST, PHASE ONE, A SUBDIVISION, PREPARED BY LONDON LAND SURVEYING, CLEVELAND, GEORGIA, AND A. DARIN CAIN, GEORGIA REGISTERED LAND SURVEYOR, RECORDED IN PLAT BOOK 43, PAGE 70, OFFICE OF CLERK, SUPERIOR COURT, WHITE COUNTY. GEORGIA. REFERENCE IS HEREBY MADE TO SAID PLAT OF SURVEY AND THE RECORD THEREOF FOR A MORE COMPLETE DESCRIPTION OF SAID PROPERTY.
TOGETHER WITH THOSE EASEMENT RIGHTS ARISING UNDER THAT CERTAIN AMENDED AND RESTATED PROTECTIVE COVENANTS, CONDITIONS, AND RESTRICTIONS FOR WOODLAND FOREST, PHASE ONE, BY RITA A. BLACK, JOHN D. PALMOUR, AS AGENT AND ATTORNEY-IN-FACT FOR JUNE W. PARKS, RICKY PARDUE AND JOHN D. PALMOUR, RECORDED IN DEED BOOK 581, PAGE 146, WHITE COUNTY, GEORGIA; AS AFFECTED BY THAT CERTAIN QUIT-CLAIM DEED FROM RITA A. BLACK (AS TO AN UNDIVIDED ONE-FOURTH INTEREST) AND JUNE W. PARKS (AS TO AN UNDIVIDED ONE-FOURTH INTEREST) TO JOHN D. PALMOUR AND RICKY D. PARDUE, DATED APRIL 1, 2005, RECORDED IN DEED BOOK 1014, PAGE 103, AFORESAID RECORDS.
Upon information and belief of lender, said property is commonly known as 124 Greenview Court, Cleveland, Georgia 30528.
The said debt secured by the said Security Deed being in default, said sale will be made for the purpose of paying the same and all expenses in connection with this foreclosure including but not limited to all accrued and unpaid interest, attorney s fees and expenses of sale.
Upon the best information and belief of Lender, the above-described property is in the possession of the Borrower, and/or tenants of Borrower or other persons or entities in possession with the consent or acquiescence of Borrower.
The entity that has full authority to negotiate, amend, and modify all terms of the mortgage with the debtor is: Regions Bank, 20901 S.W. 112th Avenue, Miami, Florida 33189 at 305-259-4405. Please understand that the secured creditor is not required to negotiate, amend or modify the terms of the mortgage instrument.
Said property will be sold as the property of Yonah Walls & Ceilings, Inc., a/k/a Yonah Walls and Ceilings, Inc. and subject to any outstanding ad valorem real property taxes (including taxes which are a lien, but not yet due and payable), any matter which might be disclosed by an accurate survey and inspection of the property, any assessments, liens, encumbrances, zoning ordinances, restrictions, covenants and matters of record superior to the Security Deed first set out above. The sale will be conducted subject to confirmation that the sale is not prohibited under the U. S. Bankruptcy Code and to final confirmation and audit of the status of the loan with the holder of the security deed.
