NOTICE OF SALE UNDER POWER
STATE OF GEORGIA
COUNTY OF TALBOT
Under and by virtue of the power of sale contained in a Deed to Secure Debt and Assignment of Rents by Brittland Properties, Inc., Michael B. Moon and M. Britton Enterprises, Inc. f/k/a The Moon Family Corporation ("Grantor") to Wachovia Bank, National Association ("Grantee"), dated February 1, 2008, recorded in Deed Book 297, Page 247, Talbot County, Georgia records, and securing a loan in the original principal amount of $1,500,000.00, (the "Security Deed"); there will be sold at a public outcry for cash to the highest bidder before the Courthouse door of Talbot County, Georgia, between the legal hours of sale on the first Tuesday in March, 2009, by Wachovia Bank, National Association, as Attorney-in-Fact for Brittland Properties, Inc., Michael B. Moon and M. Britton Enterprises, Inc. f/k/a The Moon Family Corporation the following property to-wit:
All that lot, tract and parcel of land situate, lying and being in Land Lot 22, 17th District, Talbot County, Georgia, containing 37.80 acres, and being known and designated as TRACT 1 on that certain map or plat entitled "Plat of the Property of W.A. Pierce, 17th Land District, Talbot County, Georgia", dated October 9, 1980, prepared by Hugh P. Riley, Registered Land Surveyor, and recorded in Plat Book F, page 263, of the records in the Office of the Clerk of the Superior Court of Talbot County, Georgia, to which plat reference is hereby made for a more complete and accurate description of the property herein conveyed.
There is now situated upon said lot 3766 Dennis Creed Road, according to the present system of numbering dwellings in Talbot County, Georgia.
The indebtedness secured by said Security Deed having been declared due and payable because of, among other possible events of default, failure to pay the indebtedness secured thereby as and when due, this sale will be made for the purpose of paying the same and all expenses of sale, including attorney's fees (notice of intention to collect attorney fees having been given).
Said property will be sold subject to any outstanding ad valorem taxes (including taxes which are a lien, but not yet due and payable), any matters which might be disclosed by an accurate survey and inspection of the property, any assessments, liens, encumbrances, zoning ordinances, restrictions, covenants, and matters of record superior to the Security Deed first set out above.
To the best of the undersigned's knowledge and belief, possession of the subject property is held by Brittland Properties, Inc., Michael B. Moon and M. Britton Enterprises, Inc. f/k/a The Moon Family Corporation.
